On April 4th, 2009, Richard Poplawski opened fire on Pittsburgh Police Officers during a domestic disturbance call, killing three of them. The three dead officers are Eric Kelly, Stephen Mayhle and Paul Sciullo III. Kelly had been on the force for 14 years and the other two only two years each. Another officer was shot in the hand and a fifth broke his leg on a fence. Although Clearly Pre-Metitaded, Poplawski is charged with 3 counts of homicide, instead of capital murder.
A person is guilty of capital murder if he knowingly causes the death of:
(a) A law enforcement officer or a judicial officer acting in the line of duty or when the death is caused as a consequence of or in retaliation for such person's actions in the line of duty. If what happened on April 4th doesn't constitute as Capital Murder then what does?
