JUDGEMENT OR JOKE
Civil Liberties Monitoring Committee, India (CLMCI) condemning the announcement of judgment for sentenced to life imprisonment to 16 Muslim youths by Addl.Family judge at Nampally criminal court Hyd, on 28/06/2004 without preparation of written judgment in S.C.No 358/2000. The accused 16 Muslim youths didnt received copy of judgment till the date, which is blunder mistake, ignorance, and the violation of CRPC 353 and 363, According to CRPCThe judgment in every trial in any Criminal Court or original jurisdiction shall be pronounced in open Court by the presiding officer immediately after the termination of the trial or at some subsequent time of which notice shall be given to the parties or their pleaders When the accused is sentenced to imprisonment, a copy of the judgment shall, immediately after the pronouncement of the judgment be given to him free of cost.
CLMC INDIA today received a copy of written complain by prisoners addressing to chief justice of A.P requesting for justice.
The prisoners also complained that the trial conducted at cherla pally central jail where all the facilities are not available to defend themselves, because it is a far away place from the city, and accused advocates were not in position to prepare and attend the court. While all facilities are available to police, police brought witnesses in police van with preparing the mind and keep close watch on them in court premises also and bring backed them to in their custody. So here the witnesses are not free, they were under the police pressure. The Advocates registered their protest and objections but the judge rejected it.

At the time of announcement of so called judgment no person even parent of accused not allowed to in the premises of court, but court room was full of police personals. This is also violation of CRPC.
By keeping in view of above circumstances CLMC INDIA believe that the trial is against the international standard of free and fair trial. It is an unfair trial because the judge violated the Internationally recognized norms and also criminal procedure system.

The Addl J.H.C.B.B.C cum Addl. Family Judge of Nampally criminal court announces the judgement, for life imprisonment, which is not in written till date, under the police pressure.CLMC INDIA, express its deep concern over the trial in lower courts of A.P by following the Gujarat courts as example.

CLMC INDIA demanding the govt to start re trial this case No 358/2000,and ensure the free and fair trial. And appeals to all human right and civil liberties activists to come forward to protect the rights of the prisoners and ensure justice to them. They should keep in mind that
