Israeli Crimes Against Humanity in Palestine

To: The High Contracting Parties to the Fourth Geneva Convention of 1949

We, the undersigned, call upon the High Contracting Parties to the Fourth Geneva Convention to fulfil

Their legal obligations to ensure respect for the Convention by the Israeli authorities in the ocuupied Palestine particularly in Gaza Strip. We call upon you to use all lawful means to

End the Occupation so called Israel's use of collective punishments such as mass murder of civilians, house demolitions, mass arrests, prolonged, curfews, deportations, land confiscation, roadblocks and checkpoints, and the Annexation Wall ;against the Palestinian civilians.

Such penalties pay no regard to individual responsibility, and are inflicted solely on the basis of national and ethnic identity.

Collective punishments are a violation of international humanitarian law, including Article 50 of the Hague Regulations annexed to the Fourth Hague Convention of 1907, and Article 33 of the Fourth Geneva Convention. The International Committee of the Red Cross (ICRC) notes that the legal prohibition on collective punishments does not allow for penalising an entire population on the basis of "passive responsibility." Although Israel is a High Contracting Party to the Convention, it does not accept the de jure application thereof to the West Bank and Gaza Strip. However, the Arab Students Observatory for Victims of Occupaion & Blockade -ASO- and the international community have consistently affirmed its applicability to these areas. As such, Israel has an obligation under international law to cease all such punishments which undermine the quality of life of the Palestinians and violate their fundamental rights and freedoms.

Moreover, in light of Israel's continued illegal use of such penalties, other High Contracting Parties to the Fourth Geneva Convention are obliged under Article 1 to "respect and ensure respect for the present Convention in all circumstances." We urge you to give meaning to your obligation by engaging the Israeli Government for its breaches of the Convention, and directly intervening in order to deter such crimes so that the necessary protections for the Palestinians are provided to them. Ensuring the rights of Palestinians as Protected Persons under the Convention is not merely the legal obligation of the Israeli authorities, but of the international community as a whole.

We demand the exile of Israel from the United Nations and demand International court marshal for Israel in regards of War Crimes and Crimes Against Humanity in Palestine & Lebanon.
