Whereas, the three key state witnesses are herein described as: the alleged victim, A.C.; the alleged eyewitness R.B.; the alleged outcry witness D.C.
Whereas there has never been any physical evidence to support the conviction of Jay B. Van Story;
Whereas prosecutors threatened and coerced A.C. to lie at trial and falsely accuse Van Story;
Whereas Lubbock County investigators fabricated allegations against Van Story and forced all three key state witnesses to engage in perjury under the threat of being permanently separated;
Whereas A.C. has fully recanted her testimony and expressed deep sadness and regret about having been coerced into falsely accusing Van Story;
Whereas A.C. has repeatedly identified R.B. as her actual abuser, and R.B. has fully recanted his eyewitness testimony in court in 1989, and admitted that his original, repeated statements that Van Story is innocent are true;
Whereas the original, repeated and spontaneous statements of all three key witnesses are that Jay Van Story is actually innocent of the crimes he was accused of;
Whereas in 1990 a federal judge found that D.C. had been forced to falsely testify against Van Story under the threat of losing custody of A.C.;
Whereas D.C. confessed on her deathbed in 1999 that she was indeed forced by investigators and prosecutors to falsely testify against Van Story;
Whereas the former prosecutors have been severely admonished by several state and federal courts for having knowingly presented false testimony and false evidence, having covered up evidence of innocence, and having prosecuted numerous cases in bad faith;
Whereas it is patently obvious that the conviction of Jay B. Van Story has resulted in a tragic miscarriage of justice, and undermines the publics faith in the Texas criminal justice system; and,
Whereas this country has provided no legal venue where an innocent and indigent person can have his case fully reviewed on its merits with his right to due process secured;
The citizens of Texas and the Unites States have a legitimate interest to expect that their right to be free from malicious and wrongful prosecution be protected by state courts.
We, the undersigned, petition the Governor of Texas to exercise his authority to immediately grant a Full Pardon to Jay Van Story.
