While we respectfully recognize that Maverick is legally authorized, by a contract made with the Deftones under the band's own free will, to control the distribution of the Deftones music; we must protest the actions of a third party that is, however legally, impeding the free interaction between the Deftones and ourselves toward an end we feel is not productive. As consumers who have provided ongoing financial support for the Deftones, and thus Maverick, we have a reasonable expectation that our concerns be weighed into Maverick's final decision as to the distribution of the removed audio.
We believe that the permanent removal of the "bootleg" audio will negatively impact the overall relationship between the Deftones and ourselves. The financial gain Maverick makes from the Deftones is dependent on the relationship between us, the fans, and the band. We are hoping Maverick will see the bigger picture of how the distribution of free live "bootleg" audio contributes positively to our relationship.
We, the fans, buy Deftones records because we feel that we can relate to and connect with the group, and because the band makes themselves amply accessible to the us. We believe that releasing free live "bootleg" audio is an effective way for the band to connect with and make themselves accessible to the fans.
Free live audio encourages those who haven't been consistently hearing from the Deftones via press and radio to go out and buy their records, current and as well as past releases. It makes us, Deftones fans, feel all the things that made us support the group in the first place; it renews a sense of connection, also resulting in the increased sales of records and merchandise. It makes new fans feel for the first time that the band is relatable and accessible; we are able see the band as real people just like us through hearing them in a live context. We also recognize and appreciate that the band made a conscious effort to connect with us. We are eager to support a group like the Deftones who reciprocate the support, energy, effort, and emotion we give openly to them through small gestures like providing free live audio.
We believe that the long-term financial productivity of the Deftones will remain the same or increase if the free distribution of the removed audio is allowed to continue because it acts as an incentive to consumers. The choice to continue the free distribution of the audio would also contribute to our lives, as well as the lives of the Deftones, through permitting us to engage in a positive form of expression and exchange.
We are asking that Maverick do the following:
1.Give the Deftones authorization to distribute some, or all, of the live "bootleg" audio removed from www.deftones.com to the general public for free, either,
a. in the original medium, www.deftones.com, or,
b. in another medium to be determined by Maverick,
for whatever length of time the Deftones wish to do so.
