Dear Mr. President:
Wen Ho Lee is the only American who has been charged with felonies where there is evidence of security violations but there is no evidence of transfer of classified information to an unauthorized person. Other civilians who similarly have broken security rules, most notably John Deutch, as a matter of policy do not incur felony charges but are disciplined by appropriate administrative procedures.
When Wen Ho Lee tried to cooperate with the FBI he was subjected to a brutal interrogation and death threats. For months before his arrest government leaks about the investigation of Wen Ho Lee resulted in a media frenzy and invasion of his privacy.
After his arrest Wen Ho Lee suffered nine months of pretrial solitary confinement under cruel and severe conditions. His pretrial incarceration was needless, a result of false testimony by an FBI agent. He finally gained his freedom by pleading to a single technical felony count of mishandling classified material.
The Wen Ho Lee case stands as an example of a miscarriage of justice that should be remedied. His treatment at the hands of our government weighs heavily on his fellow scientists, the national laboratories, and other Americans. Indeed, the unfair treatment of Wen Ho Lee shakes the confidence of the American public in the protections guaranteed by our United States Constitution.
Therefore, we, the undersigned, urge you to grant a pardon to Wen Ho Lee on behalf of the entire country.
