On October 21, 2010 the federal government introduced Bill C-49 in Parliament. The Bill is introduced as an anti-human smuggling measure. Bill C-49 proposes changes to the Immigration and Refugee Protection Act that centre on prohibiting human trafficking in Canada. However, the Refugees Awareness Group notes that contrary to claims made by the government, the Bill does little to constrain the criminal activities of human smugglers and instead may penalize legitimate refugees. The majority of provisions are focused on the treatment of refugees based on their mode of arrival to Canada. They violate the Canadian Charter of Rights and Freedoms, and Canadas international human rights obligations. There are very few provisions that are focused on preventing or dealing with human smuggling, and are instead impeding on the fundamental rights and level of ease legal refugees face when they arrive in Canada.
We are asking Member's of Parliament to defeat Bill C-49. The government should address the problem of smuggling in ways that do not punish refugees.
