Whereas section 3 of the Canadian Charter of Rights and Freedoms states: Every citizen of Canada has the right to vote in an election of members of the House of Commons or of a legislative assembly and to be qualified for membership therein;
Whereas section 6.1 of the Canadian Charter of Rights and Freedoms states: Every citizen of Canada has the right to enter, remain in and leave Canada;
Whereas section 3 of the Canadian Elections Act states: Every person who is a Canadian citizen and is 18 years of age or older on polling day is qualified as an elector;
Whereas the Supreme Court of Canada has repeatedly struck down attempts to limit the rights of Canadian citizens to vote for any reason;
We, the undersigned, believe that a Canadian citizens right to vote is inalienable. We believe that any attempt to abridge or deny this right to vote to citizens living outside of Canada is unconstitutional and violates the spirit and letter of the Canadian Charter of Rights and Freedoms. We further demand all of our representatives and elected officials to stand up for the rights of all Canadian citizens living outside of Canada to exercise their democratic right to vote.
Therefore, we, the undersigned, demand that sections 11(d) and 222(1) of the Canadian Election Act, which limit the vote to a person who has been absent from Canada for less than five consecutive years and who intends to return to Canada as a resident, be struck down. We further demand that the right to vote be restored to all Canadian citizens living abroad, regardless of the duration of their absence from Canada.
