We ask you to support the Employee Free Choice Act and to help it pass Congress as soon as possible. The EFCA would allow millions of hard-working Americans and residents of this country to join and form unions without the threat of harassment, intimidation and losing their jobs. Every worker should have the right to organize freely and your support of the EFCA is absolutely crucial to protect this right. The current process for forming unions in the United States is skewed in favor of employers who typically oppose unions. Workers must literally risk their jobs in order to execute one of their most fundamental rights.
We believe that you are well aware of the fallacy behind the most common argument against this crucial bill. The EFCA does not strip American workers of the right to a secret-ballot election. On the contrary, the EFCA would allow employees to decide whether to join or form a union AS THEY WISH, by card check OR by a secret-ballot election if 30\% of the employees petition for such an election. In addition, the EFCA would impose stricter penalties on employers who violate provisions of the National Labor Relations Act when workers seek to form a union and thus decrease the number of illegal firings.
We are aware of the fact that you have been under constant pressure from various organizations urging you to oppose the EFCA. However, please keep in mind that businesses opposing this bill are not concerned about their employees' right to a secret-ballot election. Their strong opposition is not selfless, it is driven by profit alone.
The current situation is a disgrace to the United States and practically unheard-of in most other western countries. As the Senator of Arkansas and a member of the Democratic Party and its long history of defending workers' rights we count on you to end this injustice once and for all by supporting the EFCA in Congress in its present form and by wholeheartedly voting for this most important piece of legislation.
