SETTING BACK RESPECT OF PLURALITY WITHIN FRENCH SOCIETY

Laicite is right at the heart of deep controversies in France. (This term indicates the specific way Churches and the State are separated under French Constitution).

The emergence of new religions, the coming of new spiritual or philosophical trends world-wide seem to challenge a certain vision of laicite.
Besides, a major part of those groups have been progressively driven out of the french society for the last ten years, these new movements having as a common denominator to envision a constructive alternative to growing materialism.
We hereby would like to remind that a modern democracy is majorly characterized by a co-existence of divergent opinions and visions which, beyond plain political pluralism, does not allow for a unique thought to dominate all others, which would constitute an undisputable regression.
Being well involved in the heart of this controversy, the french State is bond to neutrality and must guarantee the free expression of anyone's convictions, per article N1 of the French Constitution and article 9 of the European convention of Human Rights which it has ratified. The State must also guarantee free practice of cults as laid down in the 1905 law which defines the foundation for laicite.
Those basic texts allow each french citizen to freely express his beliefs or opinions, without fear of retaliations, being understood that each and all must feel free to support or not any given movement or opinion.

Having witnessed quite some discriminatory behaviors within State institutions or public services, we therefore demand :

1/ That the French State, in its laws or advices to his agents, abstain from promoting politics aimed at discrediting the majority of new trends regarding spiritual and religious search, as well as new approaches in education and health which encompass the whole of human personality.

2/ That the french State and its institutions stop subsidizing associations - in particular ADFI and CCMM - whose claimed purpose and practice is to blacklist those movements mentionned above, thus making the respect of article 1 of the French Constitution impossible, which states the " The French Republic respects all beliefs. "

3/ That National Education, so-called " laique ", return to its long-term tradition of plain neutrality in regards to beliefs and religion, and had any campaign, lecturing, indoctrination or writings being barred from educational system, avoiding then that children sundenly discover that their parents are stigmatized because of their legitimate beliefs.

4/ That the French State dissipate ambiguity and at last show a clear political commitment to respect its obligations by setting up ways, including laws, to protect its citizen from any discrimination based on religion, convictions or philosophical opinions, and make sure that freedom of showing one's beliefs or convictions is respected.

In the case the french State could not or would not guarantee those fundamental rights, we commit ourselves to apply to european and international bodies in order to make those rights respected.

PETITION POUR UNE LAICITE FRANCAISE AUTHENTIQUEMENT PLURALISTE

La laпcitй est au coeur des dйbats dans notre pays.
L'йmergence de nouvelles religions, l'arrivйe avec la mondialisation de nouveaux courants spirituels ou philosophiques semblent dйfier une certaine vision de la laпcitй. Cette vision restrictive cherche а confiner le fait religieux entre les quatre murs de la sphиre privйe en lui barrant le chemin vers la vie publique.
De plus, nombre de ces mouvements ont йtй mis progressivement au ban de la sociйtй franзaise depuis une dizaine d'annйes, ces groupes ayant pour caractйristique commune de proposer une alternative constructive au matйrialisme envahissant.
Nous rappelons que la caractйristique universellement reconnue d'une dйmocratie moderne consiste en une coexistence d'opinions et de visions divergentes qui, au-delа d'un simple pluralisme politique, exclut la domination d'une pensйe majoritaire, ce qui serait une rйgression incontestable.
Prйsent au coeur de ce dйbat, l'Etat franзais est soumis а une obligation de neutralitй et doit garantir la libre expression des convictions, de par l'article 1 de notre constitution et l'article 9 de la Convention Europйenne des Droits de l'Homme qu'il a ratifiйe. Il est tenu йgalement de garantir le libre exercice du culte tel qu'йnoncй dans la loi 1905 qui dйfinit le fondement de la laпcitй. Ces textes fondamentaux confиrent а chaque citoyen franзais le droit d'exprimer librement ses croyances ou opinions, sans crainte de reprйsailles, йtant entendu que chacun doit rester libre d'adhйrer ou non а tel ou tel mouvement ou opinion.

Ayant constatй un certain nombre de dйrives discriminatoires au sein d'institutions de l'Etat ou de services publics, nous demandons donc :

1/ Que l'Etat franзais, dans ses lois et dans les directives а ses agents, s'interdise de promouvoir une politique visant а porter le discrйdit sur l'ensemble des options concernant la recherche spirituelle et religieuse, aussi bien que dans les approches de l'йducation et de la santй qui prennent en compte l'кtre humain dans sa globalitй.

2/ Que l'Etat franзais et ses institutions cessent de subventionner des associations qui militent contre les spiritualitйs nouvelles- en particulier l'ADFI et le CCMM - ces associations ayant un but explicite et une pratique qui conduisent а la mise а l'index desdits groupes ou individus, rendant impossible dans les faits le respect de l'article 1 de notre Constitution qui affirme que " La Rйpublique franзaise respecte toutes les croyances ".

3/ Que l'Education Nationale, rйputйe laпque, revienne а sa tradition de stricte neutralitй en matiиre de croyances et de religion, faisant cesser toute campagne, confйrence, endoctrinement ou littйrature interne discriminatoire, qui font qu'aujourd'hui, des enfants dйcouvrent soudain que leurs parents sont stigmatisйs pour leurs convictions lйgitimes.

4/ Que l'Etat sorte de l'ambiguпtй et affiche enfin une volontй politique claire de respecter ses obligations en se dotant de moyens, y compris de lois, pour protйger ses citoyens de toute discrimination fondйe sur la religion, les convictions ou les opinions philosophiques et faire que la libertй de tйmoigner de sa foi ou de ses convictions soit respectйe.

Dans le cas oщ l'Etat franзais ne pourrait ou ne voudrait pas garantir ces droits fondamentaux, nous nous engageons а agir auprиs des instances europйennes et internationales pour faire respecter ces droits.
