During the afternoon of September 11th, 2005, VerNon Van was circulating a statewide iniative inside the stadium parking lot of Miami, Florida's Pro Player Stadium when officers illegally escorted him to a public sidewalk, thus preventing him from exercising his constitutional rights. One of the officers at the scene had left the area to inform Officer Alberto Acosta of the situation, whom at the time, was directing traffic nearby. As Mr. Van walked toward his vehicle, Acosta ordered him to walk back towards his direction and cross the street from where he was standing. Mr. Van complied with his request.
Without provocation, Acosta engaged into a physical struggle with Mr. Van, attempting to throw his body towards oncoming traffic. Mr. Van pleaded with the officer to stop his agression, explaining to the officer that he was going to be hit by vehicles coming in their direction. Officer Acosta replied, I don't give a damn. A second attempt by the police officer nearly landed Mr. Van into oncoming traffic on this dangerous multi-lane highway, forcing vehicles to slam their brakes.
As a result of his actions, he indicated to Acosta of his plans to sue. The officer manaically yelled back that he was the [f**king] police several times, insisting that he couldn't be sued. As Mr. Van walked away from the scene, the officer ran towards him shouting I'll give you something to sue me about! With his back facing Acosta, the officer grabs Mr. Van from behind, slamming his head into the concrete. Mr. Van did not retaliate from his attack and was immediately examined by the paramedics when they arrived. Mr. Van, who sat on the curb in disbelief, had noticeable cuts and scratches all over his body as well as injuies to his head. At the time of this writing, he has problems feeling sensation in his fingers and has a swollen foot that forces him to walk with a slight limp.
This reprehensible and unprofessional act of agression is NOT acceptable, thus the service of this petition. His brutality towards Mr. Van makes him unfit to serve his position. We demand the immediate termination of this officer from the police force.
