Domnule Presedinte,
Suntem un grup de romani si in calitate de cetateni romani si europeni,dorim,prin intermediul Dvs.sa ne adresam intregii Comunitati E
uropene ,in virtutea prevederilor art.I.11 alin 1,3 din Constitutia Europeana.

Poporul roman a dorit sa intre in UE , sa treaca la o democratie autentica ,si a facut acest lucru prin vointa sa proprie si cu entuziasm.
Acest apel vrea sa atraga atentia asupra derapajelor unei societati divizate,a unui politic care actioneaza antidemocratic si care a confiscat idealurile unui popor doritor de adevaratele valori ale democratiei si care s-a saturat de jumatati de masura.
Dorim ca nimeni sa nu incetineasca procesul integrarii si sa ne ia sperantele pentru o viata mai buna,Romania inregistrand un regres considerabil,la doar cateva luni de la data aderarii.

De aceea,

ne permitem sa va adresam acest apel Dumneavoastra,ca si garant al promovarii valorilor democratiei si al egalitatii cetatenilor UE, asa cum prevede art.I-10 si art.I-44, din Constitutia Europeana.


Aderarea la UE a insemnat pentru noi, ca simpli cetateni, ruperea de trecut, precum si privirea, speranta si credinta intr-un viitor mai bun, alaturi de reperele acestei reusite - presedintele Traian Basescu, ministrul justitiei Monica Macovei, ministrul de interne Vasile Blaga, ministrul integrarii Anca Boagiu si multi altii, care,alaturi de poporul roman si-au dorit sa faca parte din marea familie europeana.

Climatul politic actual ,denatureaza si deformeaza mesajul cu care Romania a intrat in aceasta comunitate, pentru a-i asimila adevaratele valori democratice.Insasi artizanii actiunii de reformare a societatii romanesti,au fost inlaturati succesiv,reprosandu-li-se lipsa de rezultate,culminand cu incercarea de indepartare a presedintelui,adevaratul promotor al acestor actiuni.
Unele partide politice- PNL, PSD, PRM, PC, UDMR- s-au unit intr-o coalitie monocolora, cu scopul de a-si apara privilegiile. imorale si antidemocratice, fara ideologii comune, si in total dispret fata de mandatul primit din partea alegatorilor, fata de Constitutia Romaniei si de legile ei, care prin actiunile lor submineaza insasi principiile democratiei si ale Cartei Drepturilor Omului.

Actiunile expuse mai jos, va vor da masura incalcarilor flagrante la care am facut referire.

1. Declansarea procedurii de suspendare a presedintelui, contrar avizului negativ al Curtii Constitutionale si prevederilor Constitutiei Romaniei- art.95(1), art.96(2,4), coroborate cu art.22(2) si art.1(1); 4(10 ) si 7 din Carta Drepturilor si Libertatilor Fundamentale ale Omului, precum si art.6(1)-pentru"delict de opinie"politica:
- condamnarea comunismului:
- independenta justitiei:
- deblocarea dosarelor fostei securitati:
- demascarea grupurilor de interese din Guvern , Parlament, mass-media.

2. Negarea atributiilor Curtii Constitutionale, in ceea ce priveste validarea referendumului pentru demiterea presedintelui , prevazute in Constitutia Romaniei, la art.95(1);96(4),coroborat cu art.3 din Hotararea 21/2007 la Legea 3/2000, prin interpretarea unei legi fundamentale, dupa bunul plac si in folos propriu.

3. Limitarea dreptului cetatenilor romani din diaspora de a-si exprima dreptul la vot la referendumul din 19 mai, prin punerea la dispozitie a unui numar insuficient de sectii de vot:-http://www.hotnews.ro/articol_71639-Romanii-din-Spania-Italia-si-Franta-se-vor-inghesui-la-referendum-in-cateva-sectii-de-votare.htm
cu incalcarea art.37(1) din Constitutia Romaniei, art.5(1); 11(1,2,3) din Carta Drepturilor si Libertatilor Fundamentale ale Omului, precum si art.19 si 21 din Declaratia Universala a Drepturilor Omului.

4. Modificarea repetata a Legii Referendumului, chiar in timpul campaniei premergatoare acestuia, cu incalcarea Hotararii 21/2007 art.3, al Constitutiei Romanie- prin adaugare, la art.95(3), coroborat cu art.96 (2,3,4,),precum si nerespectarea Conventiei de la Venetia.Parlamentul a decis, calcand constitutia si normele statului de drept, sa hotarasca el procedura de urmat in urma invalidarii referendumului.

5. Incalcarea art.28 din Declaratia Universala a Drepturilor Omului, prin distorsionarea aplicarii principiilor democratiei:
- atitudini neconforme cu statutul de parlamentari-PRM-la citirea actului de condamnare a crimelor comunismului;
- manipularea prin mass-media,de catre proprietarii de trusturi de presa, partizane politic, datorita intereselor economice (PC versus Monica Macovei);
- adresarea de injurii si calomnii,de catre parlamentari,Institutiei Presedintelui-PSD,PRM,PNL,PC;
- discreditarea si santajarea membrilor Curtii Constitutionale-PSD;
- propuneri pentru o justitie privata-PNL;
- blocarea in parlament a legii ANI,mutilarea brutala, pana la ineficienta, si trecerea in atributiile celor care ar trebui amendati prin prevederile ei i-PSR,PRM,PNL,UDMR,PC;
- minimalizarea riscului aplicarii clauzei de salvgardare pe justitie,conform Titlului IV al Tratatului(TEC) si Anexei pct.3,4

6.Amanarea alegerilor pentru Parlamentul European,care contravine Directivei Consiliului 93/109/CE din 6 decembrie 1993,Actului din 20 septembrie 1976 si Legii 61/2003,art.81-82.

Aceste derapaje antidemocratice au fost privite dinspre europa cu dezinteres; in unele cazuri chiar au fost sprijinite, romanii au putut vedea lideri politici europeni care incurajeaza practici politice absolut inacceptabile:

- incurajarea pozitiilor partizane ,de catre socialistilii europeni, prin reprezentatul lor, dl. Rasmunssen si de catre liberalii europeni prin Dl. Watson.
Noi, in calitate de romani si de cetateni europeni, le cerem lor, in calitate de reprezentanti ai Europei Unite, sa se delimiteze clar si fara echivoc de practici care fac iarasi ca Romania sa fie o exceptie nedorita, un "copil bolnav" al Europei.


Consideram toate acestea ca fiind atacuri grave la principiile democratiei din Romania, ele fiind si o incalcare flagranta a principiilor Declaratiei Universale a Drepturilor Omului, a Cartei Drepturilor si Libertatilor Fundamentale, a Constitutiei Europene, precum si a Constitutiei Romaniei.
Romania s-a angajat sa respecte legile fundamentale ale democratiei citate mai sus si orice incalcare sau ignorare a lor, nu face decat sa ingradeasca drepturile si libertatile cetatenilor ei.

Credem cu convingere-conform drepturilor democratiei participative- ca Romania poate fi ajutata prin semnale ferme sa iasa din actuala criza cu sprijinul UE, cu sprijinul Dvs personal.

Appeal To The European Parliament
To Mr. Hans-Gert Poettering - president

Dear Sir,

We, as romanian and european citizens, wish to inform you that we would like to ask your assistance in addressing this statement to the entire European Community, as per European Constitution, art.I.11 (1,3).

The peoples of Romania fulfilled their wish to join European Union, to achieve the benefits of a genuine democracy, enthusiastically acting by its own will.

This appeal wishes to draw european public attention over today's romanian divised society, over the antidemocratic acting of our leading politicians, which try to confiscate the democratic ideals of a people eager to reach the values of real democracy, while getting only half measures of it.

We wish that nobody should slow-down the integration process, or seize our hopes for a better life, yet Romania's political system is actually registering a significant regress, only few months after EU accession .

This is why we wish to address this appeal to you, as a warrant for promoting the values of democracy and equal rights of the citizens of European Union, as stated by European Constitution at art.I-10 and art.I-44.

Adhering to EU meant to us, simple citizens of Romania, breaking the ties with the shadows of the past, as well as hope and belief in a better future, supporting the architects of this achievement - Romanian President Traian Basescu, Minister of Justice Monica Macovei, Minister of Home Affairs Vasile Blaga, Minister of European Integration Anca Boagiu and many others which sustained the Romanian Peoples' efforts and wishes to join the great european family.

The present political climate is misrepresenting and distorting Romania's message for achieving the real democratic values of the European Community. Even the artisans of Romania's democratic reforms were successively replaced, with false accusations of lack of results, peaking with the attempt of impeaching Romanian President, Mr. Traian Basescu, the real promoter of romanian democratic reforms.

Some political parties - PNL, PSD, PRM, PC, UDMR - have come together in a monochrome coalition, with the only purpose to protect their immoral and anti-democratic privileges, even without similar political ideology, utterly despising electors's mandate, disregarding the Romanian Constitution and Romanian Laws, acting to undermine the very principles of democracy and the Universal Declaration of Human Rights.

The following statements show the extent of their flagrant violations:

1. Starting the presidential impeachment procedures, disregarding the contrary notification of the Constitutional Court, against provisions of art.95(1), art.96(2,4) of the Romanian Constitution, corroborated with art.22(2) and art.1(1); 4(10 ) and 7 from the Charta Of The Human Rights And Fundamental Freedoms, as well as art.6(1) - for political opinion offence, as follows:
- blaming the crimes of the communism;
- independence of the justice;
- opening of communist secret service's (securitate's) files;
- exposure of illegal interests of certain powerfull businesmen, with ties in Romanian Government, Parliament and mass-media.

2. Denial of prerogatives of the Romanian Constitutional Court, regarding the validation of the referendum for presidential impeachment, as stated by Romanian Constitution, at art.95(1); 96(4), corroborated with art.3 of Ordinance No. 21/2007 to Law No. 3/2000, by interpreting Romanian Fundamental Law, in order to fulfil illegitimate wishes and interests.

3. Restrictions for the romanian citizens abroad to express electoral franchise during referendum for presidential impeachment of may 19-th, by providing insufficient number of polling stations abroad ( http://www.hotnews.ro/articol_71639-Romanii-din-Spania-Italia-si-Franta-se-vor-inghesui-la-referendum-in-cateva-sectii-de-votare.htm), disregarding provisions of art.37(1) of Romanian Constitution, as well as art. 5(1); 11(1,2,3) of Carta Of The Rights And Fundamental Freedoms, and art.19 and 21 of the Universal Declaration of Human Rights.

4. Repeated alterations of the law of the referendum, even during precursory campaign, disregarding the provisions of art.3 of Ordinance No.21/2007, of the Romanian Constitution - by additions to art.95(3) corroborated with art. 96 (2, 3,4), and failure to observe The Venice Convention. Defying provisions of the Romanian Constitution and democratic standards, their majority in Romanian Parliament took the right to decide the procedure to follow, in case of invalidation ofthe referendum.

5. Non-observance of art.28 of the Universal Declaration of Human Rights, by distorting principles of democracy:
- unfit attitudes of certain members of the Parliament - PRM - during lecture of condemnation of crimes of communism by President of Romania;
- mass-media manipulation by owners of press-trusts, politically unfair, due to economical interests (PC against Minister of Justice Monica Macovei);
- addressing insults and defamations towards Institution of Presidency, by members of Parliament belonging to parties: PSD, PRM, PNL, PC;
- discrediting and blackmailing the members of Constitutional Court (by PSD);
- intention to start a private justice in Romania, besies the State Justice (PNL);
- shutting off ANI Law in Parliament (The National Integrity Agency), maiming it to inefficiency, and turning it into a institution controlled by the Parliament by the PSD, PRM, PNL, UDMR, PC;
- maximising the risk of saveguarding clause on justice, according to Title IV of TEC-Treaty, with Annex pt.3.4

6. Delaying of romanian elections for the European Parliament, contravening to Council Directives 93/109/CE of december the 6-th 1993, as well as to the Act of september 20-th 1976 and to the Law 61/2003, art.81-82. The decision also contravened Romanian Law, being taken without and against the notification of the Home Affairs and Justice Ministers.

These non-democratic side-slips were seen from Europe with lack of interest; in some cases these were even supported by european officials; romanian citizens saw some european political leaders encouraging absolutely unacceptable political attitudes;
- encouraging partisan attitudes from the european socialists (PSE), by their representative Mr. Rasmussen, and from european liberals by Mr. Watson.

We, both Romanian and European citizens, are requesting them, representatives of the United Europe, to unequivocally stay clear of such practices, condemning again Romania to remain the undesirable exception, the "sick-child" of Europe.

We consider the above mentioned as grievous assaults against principles of democracy, as well as flagrant violations of the principles of Universal Declaration of Human Rights, of Charta Of The Human Rights And Fundamental Freedoms, of the European Constitution and Romanian Constitution.
Romania is committed to respect the above-mentioned fundamental laws of democracy, and any infringement or ignoring of these, are only restricting the rights and freedoms of her citizens.

We firmly believe - according to principles of participative democracy - that Romania could, and should be helped with firm signals to get out of present political crisis, benefiting of EU support, benefiting of your personal support.
