We the undersigned, residents of the City of Beckley, West Virginia herby pledge our support, and demand the City of Beckley to change their laws governing sidewalk repair. This petition is to hold the City of Beckley, financially & physically responsible for said repairs, instead of its residents.
Under current law, Beckley residents are responsible for sidewalk repairs adjacent to their homes, although the footage of their properties, contained in their deeds, and on record in the Beckley County Courthouse, do not include the sidewalks adjacent to their homes. The City of Beckley legally maintains the right of its streets, which includes the sidewalks. Despite this fact, Beckley law states that each resident is liable for sidewalk repairs adjacent to their homes, if needed.
If someone were to fall and get hurt, on the sidewalk in front of YOUR house, they would have the right to sue you as a property owner, for any and all damages, despite the sidewalk not being on your property. Why should we be held responsible for sidewalks which are publicly traveled, cannot be fenced into our yard, and are not contained within our property lines?
The citizens of Beckley, West Virginia pay double to triple the amount of state gas tax, than any other state on top of the Federal gas tax, and numerous other taxes including some of the work that we produce! Additionally, the State of West Virginia has income from the Lottery, where proceeds could be proportioned to cover sidewalk repairs. So why are we are still liable for repairing a public sidewalk?
