เรื่อง ขอให้เปิดเผยรายชื่อ และสถานที่ควบคุม ของผู้ถูกจับตามหมายจับและควบคุมตามพระราชกำหนดการบริหารราชการในสถานการณ์ฉุกเฉิน พ.ศ.2548

ภายหลังจากรัฐบาลได้เข้าสลายการชุมนุมของกลุ่ม นปช.ด้วยการใช้กำลังทหารและอาวุธสงครามเมื่อวันที่ 19 พฤษภาคม 2553 เป็นเหตุให้มีผู้เสียชีวิตและมีผู้ได้รับบาดเจ็บเป็นจำนวนมาก ถือเป็นการละเมิดสิทธิมนุษยชนอย่างร้ายแรง โดยได้รับการประณามและแสดงความห่วงใยจากประชาสังคมโลก อันเป็นที่ทราบกันทั่วไปนั้น ต่อมารัฐบาลโดยศูนย์อำนวยการแก้ไขสถานการณ์ฉุกเฉิน (ศอฉ.) ได้มอบหมายให้สำนักงานตำรวจแห่งชาติออกหมายจับและควบคุมบุคคลที่สงสัยว่าจะเป็นผู้ร่วมกระทำการให้เกิดสถานการณ์ฉุกเฉิน ซึ่งจากการเวปไซด์ของกองบัญชาการตำรวจสอบสวนกลาง มีรายงานว่ามีหมายจับและควบคุมดังกล่าว ภายในเขตกรุงเทพมหานครและในเขตสำนักงานตำรวจภาค 1 จำนวน 99 หมาย แต่ไม่ปรากฏรายชื่อของผู้ถูกจับและไม่ระบุสถานที่ควบคุมบุคคลดังกล่าว ตลอดจนไม่มีรายงานของสำนักงานตำรวจภาคอื่นๆ ที่อยู่ในเขตท้องที่ประกาศสถานการณ์ฉุกเฉิน ว่ามีจำนวนผู้ถูกจับตามหมายและถูกควบคุมอยู่ที่ใด เช่นกัน ซึ่งการไม่ทราบรายชื่อผู้ถูกจับและการไม่แจ้งสถานที่ควบคุมผู้ถูกจับ ถือเป็นการละเมิดสิทธิมนุษยชนแก่ผู้ถูกจับและญาติมิตร ที่ไม่อาจทราบได้ว่าผู้ถูกจับ จะมีชีวิตอยู่หรือไม่ และไม่ทราบสภาพความเป็นอยู่ด้วย

ผู้มีชื่อท้ายจดหมายนี้ขอแสดงความห่วงใยต่อผู้ถูกจับกุม โดยเฉพาะอย่างยิ่งต่อการปฏิบัติต่อผู้ถูกจับกุมในลักษณะที่อาจมีการละเมิดสิทธิมนุษยชนขั้นพื้นฐานและต้องได้รับความคุ้มครองตามกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง (International Covenant on Civil and Political Rights) ที่ประเทศไทยมีพันธกรณี โดยเฉพาะมีสิทธิได้รับหลักประกันขั้นต่ำดังต่อไปนี้


ข้อ 7 ห้ามการซ้อม ทรมาน หรือปฏิบัติใดๆอย่างโหดร้ายไร้มนุษยธรรม


ข้อ 9 ข้อ 2 ย่อย ต้องได้รับแจ้งถึงเหตุผลในการจับกุม ในขณะถูกจับกุม และจะต้องได้รับแจ้งถึงข้อหาที่ถูกจับกุมโดยพลัน


ข้อ 3 ย่อย มีสิทธิได้รับการพิจารณาคดีภายในเวลาอันสมควร หรือได้รับการปล่อยตัวไป มิให้ถือเป็นหลักทั่วไปว่าจะต้องควบคุมบุคคลที่รอการพิจารณาคดี


ข้อ 14 มีสิทธิมีทนายความที่เลือกเอง หากไม่มี รัฐต้องจัดหาให้ ต้องได้รับการสันนิษฐานว่าไม่มีความผิด และมีสิทธิให้การหรือไม่ให้การด้วยความสมัครใจหรือไม่ให้การด้วยความสมัครใจ ต้องได้รับการพิจารณาคดีอย่างเปิดเผย รวดเร็ว โดยสื่อมวลชนสามารถเข้าสังเกตการณ์ได้


สิทธิมนุษยชนตามหลักการดังกล่าวสอดคล้องกับรัฐธรรมนูญแห่งราชอาณาจักรไทย และประมวลกฎหมายวิธีพิจารณาความอาญา


จากหลักการและเหตุผลดังกล่าว เราจึงขอเรียกร้องต่อสำนักงานตำรวจแห่งชาติ ดังนี้


1. ขอให้ประกาศรายชื่อผู้ถูกจับกุมต่อสาธารณะ รวมถึงข้อกล่าวหา

2. ประกาศสถานที่ควบคุมบุคคลดังกล่าว ที่อยู่ในอำนาจของสำนักงานตำรวจแห่งชาติทุกพื้นที่ที่ได้ประกาศสถานการณ์ฉุกเฉินเพื่อให้ญาติและทนายความสามารถติดต่อได้ทันที เพื่อป้องกันข้อครหาว่า รัฐบาลซ้อมทรมานผู้ถูกจับ

3. หากผู้ถูกจับเจ็บป่วยหรือได้รับบาดเจ็บต้องได้รับการรักษา พยาบาลอย่างเหมาะสม

Subject: Calling for the Public Disclosure of the Identities and Places of Detention of Those Arrested Under the 2005 Emergency Decree



Dear Commander of the Royal Thai Police,

Cc Thai National Human rights commission, UN Secretary-General Ban Ki-moon, ASEAN Secretary General Surin Pitsuwan , United front for Democracy against Dictatorship , Mr Apsihit Vejjajiva .




During and following the Thai governments use of military force and deadly weapons to disperse the peaceful protest of the United Front of Democracy against Dictatorship, which ended on 19 May 2010, where many people died or were injured. The governments use of military force and deadly weapons against peaceful protesters represent a serious violation of the human rights. These actions were condemned and grave concern has been expressed by many sectors of global civil society.

Subsequently, as is widely known, the government, through the Center for the Resolution of the Emergency Situation (CRES), got the Royal Thai Police to issue warrants and detain individuals who had come under suspicion of being involved in creating the emergency situation. The website of the Central Investigation Bureau reports that in Bangkok and in Police Region 1, 99 warrants for arrest have been issued and arrests have been made, but neither the identities of those arrested nor the places of detention have been disclosed. In addition, there are no reports of the numbers of arrested and their identities or the places of their detention in other police regions in areas, also under the Emergency Decree.

Not making known the identities of the people arrested and their places of detention constitutes a violation of the human rights. When this information is not made public, relatives of detainees may not be aware of the arrest of their loved ones or their present condition.

The signatories of this letter wish to express our grave concern about those who have been arrested. In particular, we are concerned about the actions that may violate the basic human rights of those arrested. The rights of those arrested must be protected as per the International Covenant on Civil and Political Rights (ICCPR), of which Thailand has ratified. Article 7, amongst others, provide:

Article 7: No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Article 9, Part 2: Anyone who is arrested shall be informed, at the time of arrest, of the reasons for his arrest and shall be promptly informed of any charges against him.

Article 9, Part 3: Anyone arrested or detained on a criminal charge shall be brought promptly before a judge or other officer authorized by law to exercise judicial power and shall be entitled to trial within a reasonable time or to release. It shall not be the general rule that persons awaiting trial shall be detained in custody, but release may be subject to guarantees to appear for trial, at any other stage of the judicial proceedings, and, should occasion arise, for execution of the judgment.

Article 14: Anyone arrested or detained has a right to counsel of his own choosing; if he does not have one, the state must appoint one. Everyone charged with a criminal offence shall have the right to be presumed innocent until proved guilty according to law. Everyone charged has the right to freely choose whether to testify or not testify. The case must be tried openly, without delay, and the press must be allowed to observe the trial.

The rights outlined provisions in the ICCPR are also guaranteed in by the Constitution of Thailand and the Thai Criminal Procedure Code.

On the basis of these principles, we demands that the Royal Thai Police:


1. Disclose and make public the identities of all the people who have been arrested and their charges.

2. Disclose and make public the places of detention where these persons are being detained by the Royal Thai Police in every area in which the Emergency Decree of 2005 is in force. This is so that their families and lawyers will be able to communicate with them. This is also necessary in order to protect detainees from mistreatment, and to condemn the government if mistreats them.


3. If those arrested are ill or injured, they must receive immediate appropriate medical care.
