Bakgrunn:

Det norske Forsvaret har varslet at spesialstyrker blir sendt til Afghanistan som bidrag til USAs "Operation Enduring Freedom" (OEF) i mеnedskiftet juli/august 2005. Styrkene vil vжre under direkte amerikansk kommando, og deltar ikke som del av NATOs ISAF styrker.

Norsk deltagelse i USAs OEF-styrke er grunnlovsstridig (jfr. 25, forbud mot at norske styrker blir stillt under utenlandsk kommando og 58, forbud mot deltagelse I erobrings- eller angrepskrig eller offensive allianser), og setter norske styrker i fare for е bryte grunnleggende menneskerettigheter nedfelt i bl.a. Genиvkonvensjonene.

Amnesty International, Human Rights Watch og FNs menneskerettighetsutsending til Afghanistan har kritisert USA for sine gjentatte brudd pе menneskerettighetene under sin krigfшring i Afghanistan. I tillegg viser dokumenter lagt frem av American Civil Liberties Union og avisen The Guardian at fanger ved USAs fengsler i Aghanistan har blitt utsatt for tortur og annen umenneskelig behandling ogsе etter avslшringene om misbruk ved Abu Ghraib fengselet i Irak og ved Guantбnamo basen pе Cuba. USA og Norge har ikke undertegnet de samme folkerettslige instrumenter, og deler ikke samme fortolkning av internasjonal humanitжr rett.

Det er uakseptabelt at vеre folkevalgte representanter har tillatt at norske styrker deltar i USAs krigsoperasjoner i Afghanistan som del av USAs OEF-styrke.

Not in our name: No to terror- No to war.
War and abuse of power are not acceptable responses to terror.

Background:

The Norwegian military is scheduled to send special forces to Afghanistan to operate as part of the USA's "Operation Enduring Freedom" (OEF) in late July/early August 2005. These troops will be under direct US command, and will not be part of NATO's ISAF forces.

Participation of Norwegian troops as OEF forces is unconstitutional (according to paragraph 25, forbidding Norwegian troops to serve under foreign command, and paragraph 58, forbidding the participation of the Norwegian military in wars of aggression or conquest, or in offensive alliances), and places Norwegian forces in danger of infringing upon fundamental human rights, as defined in the Geneva convention and other international accords.

Amnesty International, Human Rights Watch, and the UN human rights monitor in Afghanistan have all criticized the US for repeated human rights abuses during its military operations in Afghanistan. In addition, documents acquired by the American Civil Liberties Union and the newspaper The Guardian show that detainees in US prisons in Afghanistan have been subjected to torture and other inhumane treatment even after abuses at the Abu Ghraib prison in Iraq and Guantanamo Bay became known.

The USA and Norway have not signed the same international human rights agreements, and do not share the same interpretation of international human rights law.

It is unacceptable that our elected representatives have allowed Norwegian troops to participate in US military operations in Afghanistan as part of the USA's OEF forces.

Petition:

We, the undersigned, members of civil society, declare outrage at the meaningless loss of life resulting from acts of terror, as well as at the meaningless loss of life resulting from the USA's wars against Afghanistan and Irak. Civilian life is equally valuable no matter where it resides, and must be respected.

Attacks on civil liberties are also attacks on civil society. We declare outrage at the State's abuses of power and attacks on civil liberties in the "war on terror," of which the killing of Jean Charles de Menezes by police in London is only the latest and most grusome example.

-We demand a full stop to the unconstitutional participation of Norwegian troops in wars of aggression under foreign command, including Norwegian participation in the USA's "Operation Enduring Freedom" in Afghanistan.

-We demand a full and independent inquiry into the reasons for the unconstitutional participation of Norwegian troops in a war of aggression under foreign command, regarding Norwegian participation in the USA's Operation Enduring Freedom" in Afghanistan.

-We demand protection of our civil liberties and full compensation for those who have suffered as the result of State attacks on these.
