This petition has one mission: to unite as one, and fight for the rights of prisoners, and their wives to create the family they both desire, and have a right to have. The 9th Circuit Court of Appeals has ruled in multiple cases that the right to procreate survives incarceration. The prison wardens have objected, and cited multiple reasons for putting a block to this option for these couples, for insignificant reasons such as it's not medically necessary, it's not sanitary, liability for packaging the specimen, and shipping it to the woman etc. Most couples do not have conjucal visits, so the only means of making their dreams come true are via artificial insemination with semen provided by the prisoner. While these prisoners may have many rights taken from them, their wives do NOT. They should have the same rights as any law abiding citizen walking the streets. So who are the wardens, or judges to deny these women of something they should be entitled to? These are the men they took vows with before God, to love, honor and cherish until death do them part. If they so desire to create a child with the man they love, there should be nothing standing in there way. One well known case was Gerber vs Hickman in 2001 in the state of California. The case was passed through several 9th Circuit Court of Appeals rulings only to be denied at the end..not only did they violate Mr. Gerbers right, but Mrs. Gerbers rights as well. He was serving a life sentence+ in California, and would never be able to father a child otherwise. Yet they denied this legally married couple of that right. We need to speak out for all prisoners, and their wives whom are wanting to have a child with their loved one! They may take rights away from our incarcerated husbands, but they CANNOT and WILL NOT take them away from us(the wives). Other cases to reference would be Skinner vs Oklahoma, and Turner vs Safley. So we are asking you to do some research, or speak with any of these wives who feel so passionately about their RIGHT to create a child with the man they love..and sign this petition to allow our voices to be heard. We are the advocates for the prisoners, their wives, and the voices of their unborn children. Thank you all!
