If you paid for BAR/BRI's bar review course between 1997 and 2006, you are a member of a class action where, for the first time in history, the class is made up of lawyers. The case is in the United States District Court, Central District California: Rodriguez, et. al. v. West, et. al. The Complaint alleges, among other things, that BAR/BRI has paid competitors to shut down and negotiated illegal agreements with potential competitors to divide the market. The lawsuit claims BAR/BRI students were overcharged about $300 million since August 1997, and it seeks treble damages.
Recently, McGuireWoods, attorneys for the class, have entered into a settlement agreement with the Defendants WITHOUT the blessing of the majority of its class representatives. The $49 Million settlement is a far cry from the $300 million and treble damages. Also, the agreement provides NOMINAL injunctive relief for future bar-takers. With this settlement, McGuireWoods gets a nice pay check and Under the proposed settlement, class members would receive $125 each, according to the name plaintiffs disputing the proposed settlement. We say thats less than 10 percent of what the average BAR/BRI course costs, and is neither accurate nor fair restitution.
Were lawyers. If were going to allow ourselves to get screwed by this blatant monopoly thats plaguing our community, then the rest of the world has no hope.
