OPPOSING A FEDERAL TAKING OF OUR PUBLIC HIGHWAYS IN KANE COUNTY
Whereas, the U. S. Congress granted Kane County highway rights across federally managed lands over a period of 110 years; and,
Whereas, Kane Countys transportation system is founded upon congressional grants of rights-of-way; and,
Whereas, federal land managers refuse to recognize any congressionally granted rights-of-way in Kane County, in the State of Utah or in the Nation; and,
Whereas, federal land managers have refused to maintain highways claimed to be under federal jurisdiction resulting in significant public safety issues and damage to vehicles travelling deteriorating roads; and,
Whereas, federal land managers are attempting to close and restrict our historic public highways in Kane County based on federal planning provisions.
Therefore, by our signature:
We, the people, vigorously oppose any attempts by employees of the Department of the Interior, Bureau of Land Management and the National Park Service to take federal control of our historic public highways.
We, the people, support the Kane County Commissioners fulfilling their fiduciary duty to protect and preserve public highways they administer on our behalf.
We, the people, urge federal land managers to recognize the Countys historic jurisdiction to manage, maintain and improve public highways across federally managed lands.
We, the people, demand that federal land managers take care of our public highways, now claimed to be under federal jurisdiction and control, in a manor preserving the publics safety until such time that the Countys public highway jurisdiction is restored either administratively or judicially.
