Mark McCombs was acquitted of many crimes due to the credibility & lack of character of a witness, whose friends even testified to the incident at hand. Stating "she said nothing happened." So how can Mark McCombs be found guilty of tampering with evidence when there was no crime? The investigation didn't occur in a timely manner, nor did the issue get pursued until the Mayor/Chief/etc get a levy passed in their city. Another officer was actively involved and even stated that "nothing happened, I was there the whole time." So why did this other party not get indicted criminally? Why did Prosecuting attorney Zimmerman withhold evidence from the Defense? Why did the Judge feel that this case shouldn't be dismissed? She felt that way, because she just didn't want this political mess to have an effect over her career and possible connections. The Ohio Revised Code states "Discovery should be commenced by all parties promptly....Discovery may be permitted by deposition upon oral examination or written questions; written interrogatories; production of documents or tangible things or permission to enter upon land or other property; and requests for admissions." Why did the prosecuting attorneys omit information from said reports, and share only what they felt necessary? The defense attorney fought to prove that discovery wasn't, filing a Motioin to Compel Discovery along with a Motion to produce Grand Jury Transcript based on false information and wrong dates involving the said crime. After the third day in trial, how can the Prosecution decide that they have new information (when Defense proved they had it all along)and try to amend the indictment, but most importantly how can someone found innocent of many crimes, by a jury of his peers, be found guilty with tampering with evidence? If there is no crime, how can evidence be destroyed pertaining to such a crime?
