United States Citizens Petition for a Fair Evidentiary Hearing of Vincent Simmons s Actual Innocence.

To: Hon. Eric Holder, United States Attorney General; and Mr. John Conyers, Chairman of the Committee on the Judiciary- House of Representatives.

We, the citizens an taxpayers of the United States of America, submit our signatures pursuant to the United States constitution; Amendment One: Against Louisiana officials in the 12th Judicial District Court; 12th Judicial District, District Attorneys office, and the Louisiana Supreme Court.

We, the citizens and taxpayers, contend that Louisiana State Prison inmate Vincent Simmons, is actually/factually innocent and has evidence to support that he did not commit the crimes of rape against the twins Karen and Sharon Sanders in rural 1977 Louisiana.

Vincent also has evidence that he was shot by a police officer related to the accusers inside the police station on the date of his arrest, while fully restrained.

No Louisiana court has ever ruled on the merits of the actual evidence that supports his claim, such as a doctors report that stipulates Sharon Sanders was a virgin after the alleged brutal attack. No state nor federal court has afforded him an evidentiary hearing.

By grace, Vincent Simmons still has a life to fight for. Not only the shooting threatened his life, but Vincent was originally charged with two counts of aggravated rape, punishable by death at the time of accusal. Only after the US Supreme Court invalidated the death penalty in Coker v. Georgia, 433 US. 584 on June 29, 1977, did the prosecution quickly amend the charges to aggravated attempted rape.

Even though the states case at trial were the actual rapes of both of the Sanders sisters.

The alleged crime occurred on May 9, 1977 and was not reported until May 22, 1977. Vincent Simmons was arrested and shot on May 23, 1977. Less than two months later, an all-white jury found him guilty on July 28, 1977.

No pre-trial motions nor investigations by defense counsel were made.
Vincent has several documents of evidence that he was not aware of at trial. Nor was the jury aware of this evidence at trial.

Vincents odyssey has been documented in the documentaries The Farm, Shadows of Doubt, and the sequel to The Farm, 10 Down: A Decade Behind Bars.

We, the citizens and taxpayers, demand that the Attorney General and the Chairman institute an investigation into Vincent Simmonss innocence, violations of his civil rights and his human dignity. We demand the freedom of Vincent Simmons.
