Protect your property from foreclosures by the Paradise Pines Property Owner
Association (PPPOA), our neighborhood homeowners association. You may not
be aware of this situation, but throughout the United States, developers have
been and are placing nonnegotiable restrictions and conditions of ownership
on properties they develop by putting homeowners associations in place. The
restrictions and conditions of these associations are listed in the Covenants,
Conditions, and Restrictions (CC&Rs) attached to the title of the property. The
PPPOA is no exception and has become increasingly intrusive into how we, the
homeowners, maintain our individual properties.

The PPPOA can use the CC&Rs to persue foreclosure if and when a lien is
placed against a property and not paid. Liens can be placed when homeowners
do not pay their yearly membership fees, but more problematic is the situation
that arises when a homeowner disputes a citation from the PPPOA that claims
he or she has vioiated any number of a multitude of CC&R rules. Yes, the board
does send out a warning letter first, and the homeowner can dispute the claim,
but if the board rules against the homeowner, and the homeowner does not
comply with the ruling, a fine will be filed against the homeowner. If that fine is
not paid, the PPPOA can place a lien against the property, and that lien can lead
to foreclosure.

The PPPOA arbitrarily and inequitably enforces the CC&R rules based on
whether complaints are made by other members or not. Violations of these rules
can be anything from:



Painting your mailbox or house a color that is not aesthetically approved
(but who decides what is aesthetically appropriate?).



Not installing an approved roof.



Not getting permits and approval from the PPPOA for projects such as
fences or taking out hazardous trees that are already approved by the
county.



Having portable carports (even though the PPPOA uses them at the club
house site).

Again, these rules are intrusive and arbitray. Plus they give the PPPOA
foreclosure power that is not a fair outcome for committing the crime of
breaking a CC&R rule.

Every ten years we, the homeowners, have the choice to decide whether we
want to keep the PPPOA. THIS IS THE YEAR TO MAKE THAT DECISION.
We must get the attention of the State Government to stop the practice of HOAs
and POAs filing foreclosure proceedings and foreclosing on our properties. Lets

take our rights back from this association. Only we can end the PPPOA by
gathering the signatures required for a petition requesting the dissolution of the
association. In addition, there is valuable property that costs us homeowners
money to maintain, just so the few members who have the desire to can gather
in the bar for their social hours and watch their new 55 inch flat screen TV that
was bought with membership dues. It is time to disband the PPPOA, sell the
properties and disburse the funds to home owner members who are paid up on
their dues. Homeowners owing late membership dues should get caught up so
their vote also counts, and they too can get their fair share of the disbursements.
