John McNicholl, Irish deportee, was arrested by the INS (BICE) on the morning of Thursday, July 17, 2003 at 5:30 a.m. as he walked out of his home in Upper Darby, Pennsylvania, on his way to work. He was deported to Ireland under the cover of surprise and darkness by the INS. Neither his lawyer nor his family were given prior warning of this. The only way the family knew something was wrong was when John's son awoke to hear the sound of his father screaming down the sidewalk. The son ran to the door to find his father being put into a car by some men. An appeal was filed that day but his deportation appeal was summarily rejected by the 5th Circuit Court in Philadelphia and he was deported instantly.

John McNicholl moved to the United States in 1984. He has two sons, Sean and Conall and a daughter, Aine, all born in the U.S. He has worked, paid his taxes, is a homeowner in Upper Darby, Pennsylvania and is a communicant of St. Lawrence's parish. He and his wife, Frankie, have been active in children's sports programs and in several Irish-American charitable events.

We the undersigned petition that our government representatives take whatever action necessary to bring John McNicholl back home to the United States and that you defend the human and civil rights of the McNicholl family.
