Dear Friends:

I am the mother of Dr. Sam Dubria. Im writing you in behalf of my son, who is a victim of a great injustice. Hes been imprisoned for nearly 16 years now. Sam was denied his constitutional right to an impartial trial. He was falsely accused of murder, a capital offense, and sentenced to life imprisonment without parole, despite the lack of material evidence. Sam was convicted on the basis of an incomplete homicide investigation, concocted accusations, speculation and flimsy evidence.

We are asking Bonnie Dumanis, District Attorney, San Diego County, to agree to reverse his conviction and/or allow my son to receive a new trial so that he can present his newly discovered evidence to a jury. The prosecutor (who is now a judge) at his previous trial in 1993, suppressed exculpatory medical record evidence. The medical examiner also did not perform a thorough investigation into Jennifer Klappers death. The jury was told that she was a normal healthy young woman. She was not. Jennifers own mother took her to the emergency room for heart problems. This evidence was withheld from the jury, along with medical examiners incomplete and changed testimony.

I am asking for you to sign the petition in the name of justice, equality, and respect for human rights. As law abiding people, it is our moral and civic duty to uphold the law and demand accountability from our public officials.

My husband and I are in the twilight years of our lives. We are both old and sick. Before we finally depart from this world, we would like to see our son regain his freedom and rightful place in society. He is a physician whose only desire is to serve the sick and the poor. Sam does not belong in the prison. He was falsely accused of murder rape. You can help restore his freedom by joining us in this campaign for justice.

I will never forget the day when he was taken away from usas if a pall of doom had descended upon the land. It was darkness all over, but then we began to fight against the evil of injustice. Our family takes courage on the words of Christ in the Gospel:

... Come, you who are blessed by my Father, inherit the kingdom prepared for you from the foundation of the world. For I was thirsty and you gave me a drink, a stranger and you welcomed me, naked and you clothed me, ill and you cared for me, in prison and you visited mewhatever you did to the least of these my brothers and sisters, you did it to me. (Mat 25:31-36)

On the cross Jesus cried out I thirst. He is calling us to respond to those who thirst for justice, for equality, for hope, and for peace, which seems to be elusive.

A PLEA FOR JUSTICE FOR DR. SAM DUBRIA
(Open Letter to Hon. Bonnie Dumanis, DA, San Diego County)

Dear District Attorney Dumanis:

We, the undersigned in exercising our First Amendment Right ask you to seek justice for Dr. Samson Dubria. He was denied a fair trial and has been imprisoned for almost 16 years.

Dr. Dubria was a young, vibrant, and brilliant man when he was falsely accused of murdering Jennifer Klapper and sentenced to life in prison without parole based on concocted lies, speculations, and flimsy evidence that could not stand the rigors of an impartial and exhaustive inquiry. Dr. Dubria was a victim of a colossal injustice committed by those who are sworn to uphold the law but were blinded by the intoxicating glamour of power, and the enchanting lights of camera and seeing their names in a book.

We rise to condemn and seek redress against this egregious miscarriage of justice. We are called upon by our moral duty to stand and defend the constitutional rights of Dr. Samson Dubria, who was pilloried, dehumanized, and condemned guilty even before his trial. It is undeniable that Dr. Dubria was denied his fundamental right to a fair trial as substantiated by the evidence submitted in his Petition for Writ of Habeas Corpus. Thus, we humbly appeal to you as an Officer of the Court, and as a personification of the majesty of the law and justice to do everything within your legal and moral authority to reopen the case in light of the evidence that has been submitted.

The jury that convicted Dr. Dubria in 1993 never heard evidence about Jennifers episodes of resting tachycardia (a heart arrhythmia) or that she was taken to the emergency room by her mother. Dr. Dubria was convicted on false and misleading testimony by the Medical Examiner and because the prosecutor (who is now a judge) suppressed exculpatory medical record evidence and misled the jury about Jennifers health.

As law abiding people who value the rights and dignity of every human being, we can no longer tolerate the unjust, unlawful, immoral and inhuman sufferings and mental torment inflicted on Dr. Dubria and his ailing and aged parents by a flawed criminal justice system. You should not protect the interest of those who wield power and influence at the expense of the Dubria family.

It is for this reason that we spontaneously speak out against this monstrous and shameful act of injustice. Dr. Dubria should be exonerated on the basis of the overwhelming evidence that he has presented to your office or at least be given a new trial in order to erase the lingering doubts in the minds of the general public. His conviction was a glaring mockery of justice, a preposterous proceeding that led to his false conviction.

If this fatal mistake is not corrected it will erode the trust and confidence of the public in our judicial institution. The record of the case clearly shows that there was no substantial evidence that proved beyond a reasonable doubt that Dr. Dubria killed Jennifer Klapper. Hence, his continued incarceration is unjustifiable and a gross violation of his human rights. Our collective voices call upon your office to act quickly and reopen the case without further delay.

In the final analysis, all men are equal in the eyes of the law. The application of justice should not be gauged on the basis of race, national origin, religion, political affiliation, social standing, and influence. We ask you to courageously stand and defend human rights as you state in your offices mission statement: Dedicated to the pursuit of truth, justice and to protect the innocent. God has entrusted you a special and enormous responsibility to uphold the law and justice and only justice you [should] pursue.

Dr. Dubria was stripped of his liberties since 1993. It is within your power to restore his freedom by agreeing to reverse his conviction, or if you believe in the merits of the charges, seek out an independent and unbiased second opinion of Jennifer Klappers death and give Dr. Dubria a chance to receive a new trial where he can fairly present his side of the case and forensic evidence to a jury.

In closing, we would like to remind you of this moving poem of J. Fulbright: "Then think that every time, alone in darkness, someone finds the courage to take a stand against the arrogance of power or lifts one hesitant hand against the tyranny of mad momentum, there is a monument." We pray that may God guide you with His wisdom and sustain you with His power to correct a twisted system of justice.
