We the voters of Volusia County wish to express to District Attorney John Tanner and Florida Attorney General Robert Butterworth that we demand justice in the case of Zaniyah Hinson. We know that Zaniyah Hinson was transported in a vehicle without the proper safety seat as required by Florida law Chapter 65C-22.001(6)(e). We also know that Zaniyah died as a result of her caregivers leaving her unattended in a locked vehicle, which Florida law prohibits under section 775.082 or section 775.083. We also know that 14 children were transported on a 7-passenger van to the field trip that resulted in Zaniyah Hinson being left on that van. Florida law Chapter 65C-22.001, section (6)(d) clearly states that it is unlawful to transport more than the vehicle manufacturers designated seating capacity. Finally, Title XLVI, Chapter 827.03(3)(a) clearly states that a person who willfully or by culpable negligence neglects a child and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to the child commits a felony of the second degree, punishable as provided in s.775.082, s. 775.083, or s. 775.084. Gentleman, your constituencies will not tolerate allowing the grotesque death of a child to go unjustified, the proof of which lay in this humble petition.
