A judge yesterday declared a crack-addicted, HIV-infected criminal a long-term offender when sentencing him for brutally sexually assaulting three women.
Justice Ian MacDonnell sentenced Christopher Dorsey, 51, of Toronto, to three years and four months on top of the 41/2 years he spent in custody waiting for his case to be dealt with.
The judge rejected the Crown's call to brand Dorsey a dangerous offender, a designation which carries an indefinite sentence.
Instead, the judge imposed a long-term offender designation on Dorsey, which means that he will be subject to yet-to-be determined restrictive conditions for 10 years after his release for the sex crimes which took place in 2003 and 2004.
Court heard crack drove Dorsey to commit acts of criminal violence and deceit over three decades.
The sex crimes he was sentenced for yesterday included a knife-point assault of a fellow crack user and an attack in which he threatened to shoot another victim. In a third incident, he held a victim hostage in an old dungeon-like boxing gym on Queen St. E. for hours, punching one of her eyes shut, court heard.
Dorsey, a former member of the Dirty Tricks bank robbery gang, has learned that if he keeps using crack, the HIV will likely kill him, court heard during his sentencing hearing.
"He has now been confronted with a diagnosis of two chronic and potentially life-threatening illnesses, at least one of which (HIV) would likely kill him if he returns to the use of crack cocaine," said MacDonnell.
"Dorsey's addiction to crack has been a constant theme in his offending behaviour for decades and (the sexual assaults) were inextricably bound up in the crack cocaine subculture," said the judge.
The judge said if Dorsey breaches any conditions of the long-term-offender order, he could be immediately jailed for that crime
