On April 13, 2009 came into force the Environmental Code of Santa Catarina State (southern of Brazil), State Law n. 14675/09. This law says in its body that: 1. Areas of preservation, such as riparian forests; will be reduced; 2. decreases areas of preservation of watersides; 3. violates legal assumptions of normative hierarchy, violating rules of Brazilian democracy.
It is an unconstitutional LAW due to the Constitution of the Federative Republic of Brazil (1988), which says that the laws of the States may not be less protective for the environment than the federal law. The Environmental Code of Santa Catarina also violates international documents ratified by Brazil:
International Covenant on Economic, Social and Cultural Rights. Approved by the Legislative Decree n. 226 (December 12, 1991) and Promulgated by Decree n. 591 (July 6, 1992).
Article 11, 2 (a): The States Parties to the present Covenant, recognizing the fundamental right of everyone to be free from hunger, shall take, individually and through international co-operation, the measures, including specific programmes, which are needed: (a) To improve methods of production, conservation and distribution of food by making full use of technical and scientific knowledge, by disseminating knowledge of the principles of nutrition and by developing or reforming agrarian systems in such a way as to achieve the most efficient development and utilization of natural resources
Kyoto Protocol. Approved in Brazil by Legislative Decree n. 144 (June 20, 2002) and Promulgated by Decree n. 5445 (May 12, 2005).
Article 2, 1 (iii): Promotion of sustainable forms of agriculture in light of climate change considerations.
Article, 2 1 (viii): Limitation and/or reduction of methane emissions through recovery and use in waste management, as well as in the production, transport and distribution of energy.
Convention on Biological Diversity. Approved in Brazil by Legislative Decree n. 2 (February 3, 1994) and Promulgated by Decree n. 2519 (March 16, 1998).
Article 8, c: Regulate or manage biological resources important for the conservation of biological diversity whether within or outside protected areas, with a view to ensuring their conservation and sustainable use.
Article 8, d: Promote the protection of ecosystems, natural habitats and the maintenance of viable populations of species in natural surroundings.
Article 8, e: Promote environmentally sound and sustainable development in areas adjacent to protected areas with a view to furthering protection of these areas.
Article 10, b: Adopt measures relating to the use of biological resources to avoid or minimize adverse impacts on biological diversity.
Economic and political interests are clear focused in keeping this code working. If it will keep working, it will open a precedent for any State of the Brazilian federation to legislate against environmental protection. Allowing it, the risk of environment problems in Brazil will grow in a geometric progression.
The state of Santa Catarina is in the Atlantic Forest biome. Nowadays, remains only 17.46\% of forest areas preserved. The state is also the largest producer of poultry and swine in Brazil, but there are no policies for preservation, which makes the development offered by this sector seriously harmful to the environment and health of the population, mainly women, for the pollution of aquifers, rivers and soil.
The heavy rains that occurred in Santa Catarina at the end of 2008, reported worldwide, and now the drought, are dramas aggravated by irregular occupations because of the lack of policies for environmental preservation. Even though the approval of the Code was not impeded, it is a portrait of how the environment is being considered in Brazil: as obstacle to development, growth and survival of small farmers.
Environment protection is a condition for development, but this requires policies for access to credit, changes in tax, besides interchange and investment in technology. The small Brazilian farmers are poor and have little access to scientific knowledge. The code was developed to benefit the local politicians and corporate agribusiness, and its maintenance may affect the environment at the national level, with losses worldwide.

DIGA NГO AO CODIGO AMBIENTAL DE SANTA CATARINA
Em 13 de abril de 2009 entrou em vigor o Cуdigo Ambiental de Santa Catarina (regiгo Sul), Lei Estadual 14.675/09. Esta lei: 1. reduz бreas de preservaзгo, como as matas ciliares; 2. diminui a бrea de preservaзгo nas margens dos rios; 2. desrespeita pressupostos legais de hierarquia normativa violando regras da democracia brasileira. Esta й uma norma inconstitucional jб que a Constituiзгo da Repъblica Federativa do Brasil, de 1988, diz que as leis dos estados federados nгo podem ser menos protetiva ao meio ambiente do que uma lei federal.
O Cуdigo Ambiental de Santa Catarina tambйm viola documentos internacionais ratificados pelo Brasil:
1. Pacto Internacional Sobre Direitos Econфmicos Sociais e Culturais. Aprovado pelo Decreto legislativo n. 226 de 12 de dezembro de 1991 e Promulgado pelo Decreto n. 591 de 06 de julho de 1992.
Alнnea a, item 2, do artigo 11 Os estados partes do presente pacto, reconhecendo o direito fundamental de toda pessoa de estar protegida contra a fome, adotarгo, individualmente e mediante cooperaзгo internacional, as medidas, inclusive programas concretos, que se faзam necessбrias para: a. melhorar os mйtodos de produзгo, conservaзгo e distribuiзгo de gкneros alimentнcios pela plena utilizaзгo dos conhecimentos tйcnicos e cientнficos, pela difusгo de princнpios de educaзгo nutricional e pelo aperfeiзoamento ou reforma dos regimes agrбrios, de maneira que se assegurem a exploraзгo e a utilizaзгo mais eficazes dos recursos naturais.
2. Protocolo de Quioto. Aprovado, no Brasil, pelo Decreto Legislativo no. 144 de 20 de junho de 2002 e Promulgado pelo Decreto no. 5.445 de 12 de maio de 2005.

Item 3, inciso viii, do artigo 2є A limitaзгo e/ou reduзгo de emissхes de metano por meio de sua recuperaзгo e utilizaзгo no tratamento de resнduos, bem como na produзгo, no transporte e na distribuiзгo de energia.
3. Convenзгo sobre Diversidade Biolуgica. Aprovada, no Brasil, pelo Decreto Legislativo n. 2 de 03 de fevereiro de 1994. Promulgada pelo Decreto n. 2.519 de 16 de marзo de 1998.
Alнnea c do artigo 8є Regulamentar ou administrar recursos biolуgicos importantes para a conservaзгo da diversidade biolуgica, dentro ou fora de бreas protegidas, a fim de assegurar sua conservaзгo e utilizaзгo sustentбvel.
Alнnea d do artigo 8є Promover a proteзгo de ecossistemas, habitats naturais e manutenзгo de populaзхes viбveis de espйcies em seu meio natural.
Alнnea e do artigo 8є Promover o desenvolvimento sustentбvel e ambientalmente sadio em бreas adjacentes аs бreas protegidas a fim de reforзar a proteзгo dessas бreas;
Alнnea b do artigo 10 Adotar medidas relacionadas а utilizaзгo de recursos biolуgicos para evitar ou minimizar impactos negativos na diversidade biolуgica.
Interesses econфmicos e polнticos confiam na manutenзгo deste cуdigo, se isso acontecer, serб um precedente para que qualquer estado da federaзгo legisle contra a proteзгo ambiental. Com uma liberaзгo dessa natureza hб risco de que o problema o meio ambiente cresзa no Brasil em progressгo geomйtrica.
A proteзгo do meio ambiente й condiзгo para o desenvolvimento, mas isso exige polнticas de acesso ao crйdito, mudanзa na carga tributбria, alйm de intercвmbio e investimento em tecnologia. O cуdigo foi elaborado para beneficiar o agronegуcio corporativo e polнticos locais, e sua manutenзгo, pode comprometer o meio ambiente em вmbito nacional, com prejuнzos mundiais.
