Property Rights Amendment

Proposed amendment to the U.S. Constitution submitted to the United States Congress

1. No private property taken for public use within the jurisdiction of the United States or within the jurisdiction of any one of the several states may be sold or otherwise transferred to any natural or legal person for the purpose of facilitating commerce for profit within the term of fifteen years subsequent to the taking.

2. After five years from the ratification of this amendment no citizen of the United States, or any association thereof, shall be compelled to pay any tax, rent or other fee in order to obtain access to or conduct commerce for profit within any real property, building or other facility that is procured, erected, maintained or operated by the United States, by any of the several states or by any entity created thereby, and the citizens of the United States and associations thereof shall have equal access to all such real properties, buildings and facilities.
