Recover Your Losses Due to Violation of State Law

The management of Archstone Apartments has violated our state rights in regards to removal of vehicles from their parking lot. Registered residents of the Archstone Apartments, Walnut Creek have had their vehicles towed away at their own expense with out proper notification. They have had vehicles towed for being parked in "Visitor" parking spaces, even though they know that they do not have adequate parking for their residents. It is not stated in the lease agreement anywhere that a vehicle in a "Visitor" space will be towed away after a certain amount of time, nor do they ever perform any action to confirm that in fact the vehicle has not moved. In accordance with CA DMV State Law 22658.2:







(22658.2) The vehicle has been issued a notice of parking violation, and 96 hours have elapsed since the issuance of that notice.

In accordance to the Vehicle Code stated above:







(e) Any owner or person in lawful possession of any private property, or an "association" pursuant to Section 22658.2, causing the removal of a vehicle parked on that property is liable for double the storage or towing charges whenever there has been a failure to comply with paragraph (1), (2), or (3) of subdivision (a) or to state the grounds for the removal of the vehicle if requested by the legal or registered owner of the vehicle as required by subdivision (f).







If the management of Archstone Apartments does not comply with article 22658.2 they are legally obligated to refund the owner of the vehicle double the cost of towing and storage, and if they do not comply with this on an individual basis, then a class action suit will be filed against them and with the help of the below signed we will get our money back.
