In doing so the state could designate a lane by applying a dotted yellow line 30 inches from the righthand side of the state and secondary roads. This would cost less than paving an entirely new lane. Something we have very little extra room for beside existing roads especially in Western NC.
As of December 1, 2004 a Bill was passed stating that a motorist will be charged 4 points on the Drivers License and be fined $500.00 if a Pedestrian or Bicyclist is struck by a motorist. This puts the motorist at a great legal disadvantage because of the grey area these inferior vehicles operate within. The Drivers License and ID Card Endorsement would also help teach these operators the rules of the road. For instance a Bicyclist is supposed to ride as close to the right side white line as practical and there is no law that gives bicyclists the right to ride two or more abreast. Many Motor Scooter and Moped users are under the age of 16. These individuals are not old enough to operate these vehicles and have not been schooled on the rules and regulations for using NC Roadways. The designated lane will give these operators the right to operate within. A bicyclist is recognized in the state of NC as having permission to operate on the NC Roadways with the exception of major Highways. These operators have the responsibility to obey the rules and regulations. However, many do not. Often times they disobey by running red lights, fail to use hand signals, leave scenes of an accident that may have been their fault, pass stopped school busses, ride under the influence and on sidewalks, and some show their IQ of #1 after a motorist safely passes because they have been told that a motor vehicle is required to pass with a full vehicles width between them and the bicyclist. A friend and former employee at the largest Bicycle shop in WNC told me this. According to Statute 20-149 when passing a vehicle on the right a margin of two feet is required.
In the event of theft of these vehicles they would be better identified because of the requirement of registering the vehicle and attaching the serial number to that registration.
The Authorities will be required to learn the new rules and regulations and could enforce them when needed. If the operators are caught commiting a moving violation or impared by drugs or alcohol the revenue from court costs and fines will only help generate more revenue within that Municipality.
I ask that you take into consideration all the reasons why we need better rules and regulations and the opportunity to identify these operators in the event of an accident or incident and sign this Petition. Forwarding this to all of your e-mail recipients will help generate enough signatures supporting it.
My next step will be to take this to the Governor and ask him to present a new Bill stating the changes and aid in passing into law.
