Srebrenica: Call to support the request of compensation for the survivors
This is a call to support the action undertaken by the victims of the genocide that took place in Srebrenica in order to obtain acknowledgment of responsibilities and a financial compensation for the survivors; the latter is crucial for their survival.
Those of the survivors scattered around the world have not received any kind of help to reconstruct their lives. They live in miserable conditions and, for some of them, in an illegal situation. Women live in camps in Bosnia-Herzegovina with their children, constantly in fear of being displaced. While living in poverty, they keep searching for the bodies of their father, husband and children.
We are trying to organize a committee of associations and people who feel concerned by this cause; such a project will succeed only if supported by a great number of us.
On the 12 th of July 2004, the survivors filed an legal action against the UN. The action was initiated with a primary goal to reach an amiable agreement. If the organization does not answer in the next two months or if it refuses to conclude such an agreement, a request will be sent before a French administrative jurisdiction.
The victims, who committed a French lawyer, are the survivors of the genocide that started on the 11th of July, 1995 in Srebrenica. This crime is unique, particularly with regards to the UN, as since 1993, the city of Srebrenica had been declared a safe area by the organization. Consequently, the people were demilitarized and the population should have been placed under the protection of the organization.
However, instead of providing the protection of this zone, the UN let the Serb enemies enter into the zone, and the killing of hundreds of unarmed men and boys could begin. For months, movements and advances of hostile Serb troops were known and nevertheless nothing was done. The analysis of the facts demonstrates that the inaction of the UN representatives, who did not accept the close air support during the very last hours before the fall of Srebrenica, in spite of Bosnian Serb Army violations and the aggressions of the United Nations Protection Force, could be interpreted as a permission to kill.
Perhaps these persons felt more accountable to their respective States than to the command of the UN and those of the Security Council. However, the UN, as an international organization, is the legal subject, responsible for the actions and inactions of its representatives.
The goal here is not to attack the UN but to make it face its responsibilities (as documented in Mr Kofi Annans report) and those of its members.
In France, and in the other countries that provided military forces, namely the United Kingdom, the Netherlands, the United States of America, and Switzerland, where most of the refugees are now living, the work consists of mobilizing the mass media and the public opinion around the judicial debate which will inevitably take place.
A debate about the international policy applied in Srebrenica the last years, and in Bosnia-Herzegovina, with the regional issues, must be initiated.
A French interministerial commission was mandated to make a report, which was published on November 2001 in order to determine responsibilities. Despite such a work, there are still many unanswered questions: one of these questions is a matter of public controversy and need to be addressed. It concerns the possibility that the French government had an understanding that the French UN hostages would be liberated against a promise that no air strikes would take place. These are only speculations, and now the truth should be known.
In front of such atrocities and mass executions, qualified as genocide by the International Criminal Tribunal for the former Yugoslavia (April 19, 2004), it remains important to arrest and begin the trial of the main protagonists of the massacre, namely R. Karadzic and R. Mladic, whose freedom, nine years after the facts, is intolerable to victims seeking justice.
The purpose of our call is to obtain a compensation for the victims through coordination of as many associations and people as possible. This will help all the women and men to go back to Srebrenica and start a new existence in decent conditions.
I, the undersigned, support the action of the Guernica association and the request against the UN in order to obtain a compensation for the victims.
