We, the undersigned citizens of West Virginia, are profoundly disturbed by Secretary Nusbaums announcement of a freeze on Aged and Disabled Waiver slots beginning on January 1, 2003. If this was prompted by budgetary concerns how can it be fiscally responsible to put two hundred people per month at risk of entering nursing homes? Based on an average cost a twenty-eight thousand per year for nursing home placement and thirteen thousand for the Aged and Disabled Waiver, the state would save 18 million dollars per year to provide services in the community. This decision by the Department of Health and Human Resources to freeze a community program under the guise cost savings is a direct contradiction of the United States Supreme Court Olmstead Decision, which sets forth the right of individuals to live in the most integrated setting. To freeze this Waiver program takes away the basic freedoms the elderly and individuals with disabilities are guaranteed, as citizens of West Virginia. The Aged and Disabled Waiver must continue to be an option for eligible individuals.
