Free Radio San Diego broadcasts news and music to San Diego county several times a week on 96.9FM.
Because FRSD does not have an FCC license to operate an FM transmission, the FCC has been and will continue and attempt to:
a) interfere with operations
b) harass operators and support personnel
c) impose fines in excess of $10,000
d) threaten incarceration
The First Amendment of the Constitution of the United Sates Of America states:
CONGRESS SHALL MAKE NO LAW RESPECTING AN ESTABLISHMENT OF RELIGION, OR PROHIBITING THE FREE EXERCISE THEREOF; OR ABRIDGING THE FREEDOM OF SPEECH, OR OF THE PRESS; OR THE RIGHT OF THE PEOPLE PEACEABLY TO ASSEMBLE, AND TO PETITION THE GOVERNMENT FOR A REDRESS OF GRIEVANCES.
As FRSD is non commercial (FRSD receives no monies through its broadcasts, it only accepts donations which are used for equipment and operating expenses), it represents an absolute First Amendment case, and the FCCs regulations are obviously contrary to that Amendment.
Fifteen radio stations in San Diego are owned by Clear Channel Communications (which owns over 1200 nationwide, and 37 television stations), and all are members of the National Association Of Broadcasters (NAB). This monopoly is financial and organizational in nature due to Clear Channel and other media corporations, and ideologically in nature due to the full NAB membership of all major radio stations in San Diego.
We ask the City Of San Diego to perform the following actions:
- Instruct the San Diego Police Department that our actions are lawful under the First Amendment, and to not comply with the wishes of the FCC.
- Express support and concern to the following agencies, in every manner possible:
- US District Court, Southern California
- US Marshals, Southern District of California
- Federal Communications Commission, Southern California Enforcement
