An URGENT Appeal To Find U.S. Military Fleeing Sailor For Rape Of Australian Woman In Japan And A Plea For The First 24-Hour Rape Crisis Center To Be Established In Japan.

In the early hours of an April day in 2002, an Australian woman was raped by a U.S. sailor inside her van in a parking lot in Yokosuka, Japan, outside a U.S. military base. After receiving an indifferent response from police, learning there was no 24-hour rape crisis center in Japan, and finding that neither Japanese prosecutors nor the U.S. Navy intended to press charges against the alleged perpetrator, she decided to take action so that future victims would not have to go through what she did.
The woman filed a civil lawsuit in 2002,seeking damages from the U.S. sailor, who was stationed aboard the aircraft carrier USS Kitty Hawk. In November 2004, two years later, the Tokyo District Court declared in the suit that the man had in fact raped the woman and ordered him to pay 3 million yen in compensation. However the woman has no way of collecting from the man because he fled Japan before the suit ended, without knowledge to any party involved at the Tokyo District Court and was in fact discharged by the U.S. Military in 2002. His whereabouts have been unknown since then. The woman also tried to hold the man's lawyer for contempt of court but the lawyer died before she could take action.
It is said to be true that while in Japan, all active duty military personnel are subject to both U.S. and Japanese laws. It is understood that members of the US Forces in Japan have certain rights, privileges and special protections which have been accorded to them by the Status of Force Agreement (SOFA) which defines the relation between the U.S. military and host country. However it is also believed that in return, the SOFA makes it the duty of all members of the U.S. Forces to respect the laws of Japan and to abstain from any activities inconsistent with the spirit of this Agreement .The Zero Tolerance decree jointly announced in 2004 by NATO's Ambassador of Norway Kai Eide and Ambassador Nicholas Burns of the U.S.A. denounces trafficking and purchasing of sexual activities by all of their military personnel and is supported in full by Deputy Secretary of Defence Paul Wolfowitz. We believe that this spirit of Zero Tolerance of sexually violent activities against women must be extended to crimes such as rape and be fully investigated and prosecuted in all countries that host the U.S. military.
We believe that military commanders are responsible for seeing that individuals under their authority who run afoul with host - country laws ensure that these laws be respected while in the host country of Japan. The Uniform Code of Military Justice, the foundation of military law in the United States regulating military personnel conduct must also be re-examined to strongly enforce prosecution of sexually violent activities globally.
The US military was fully aware that the defendant had an ongoing court case against him in Japan. Therefore the law was not upheld when he was discharged by the US Military immediately after him retaining a lawyer and blatantly fleeing this court case for rape against him.
This petition is written to demand a thorough, professional and transparent investigation to be carried out without delay to find this rapist who has received immunity and has not been held accountable for his crime, with absolutely no action taken against him.
PLEASE DO NOT LET HER RAPE CASE EXEMPLIFY THE USUAL IMPUNITY AND LACK OF REGARD FOR SEXUAL VIOLENCE COMMITTED BY THE U.S. MILITARY.
TIME IS OF THE ESSENCE DUE TO THE STATUTE OF LIMITATIONS TO FIND THIS FLEEING RAPIST AND WE URGE YOU TO CIRCULATE THIS PETITION TO YOUR FRIENDS AND SIGN THE BELOW.
