The Long Beach Police Department in the State of California has begun issuing parking violations to pickups parked on the streets of the City of Long Beach. The Municipal Code cited is 10.40.010 Truck not on Truck Route. The Municipal Code was written many years ago and was intended for big semi trucks, tractor trucks and busses. It states B. When any such truck route or routes are established and designated by appropriate signs, no operator of a commercial vehicle, as defined in Cal. Veh. Code Section 260, Subd.(a), exceeding a maximum gross weight of three tons shall operate or park, and no vehicle for hire or advertised for hire shall park, along any other route or routes. Since the time that the code was written, the State of California has required all pickups be registered as commercial vehicles so owners may legally carry property (anything other than groceries) in the open bed. Pickups are defined as pickups on the DMV registration, not trucks. The maximum unladen weight of a pickup according to the State of California is 8,000 pounds, or four tons. These vehicles are our daily drivers and for many our livelihood.
We, the residents of the City of Long Beach, petition the members of the Long Beach City Council to amend Municipal Code 10.40.010 (b). The amendment should remove the words exceeding a maximum gross weight of three tons and replace them with exceeding a maximum unladen weight of four tons, to conform to the Laws of the State of California.
