DENY
THE JOINT PETITION OF
THE SUNSET PARK HOMEOWNERS ASSOCIATION
AND
THE BUENA PARK HOMEOWNERS ASSOCIATION
REQUEST FOR A NO ANCHOR
DESIGNATION
Whereas, Chapter 6.06(D) of the Fox Waterway Agency Code of Ordinances
establishes the criteria whether to and to what extent to designate an area as
restricted. This section of the Code states that:
D. A petition requesting that an area be designated restricted shall not be
granted unless at least one of the following criteria are met:
1. A boating safety hazard currently exists; or
2. A public safety concern relative to other common water uses (e.g.,
swimming, skiing, etc.); or
3. A boating user conflict exists.
The issue or protection of private property is not appropriate criteria for designating a specific area as restricted.
Whereas, The Homeowners Associations joint petitions claims of illegal trespass and interference with the use of and enjoyment of association parks are clearly issues of private property. There are existing laws against such occurrences that should be enforced, before there are restrictions placed on public waterways.
Now, Therefore, The Concerned Citizens for the Chain of Lakes Community petition the Board of Directors of the Fox Waterway Agency to:
1. DENY the joint petition of The Sunset Park Homeowners Association, and
The Buena Park Homeowners Association request for a No Anchor designation.
Wherefore, The Petitioners are 18 years of age or older and interested in the subject matter of this petition.
