On February 6 2006 while exiting a store several miles from his home, police approached Hal Adams, a disabled American Indian man and placed him under arrest for possession of cocaine and intent to manufacture meth amphetamine.
It was a unwarranted arrest.

When an arrest warrant finally materialized, it was dated Feb. 6th, 2006 while the affidavit to obtain the warrant was dated the following day on Feb. 7th, 2006. The warrant also states that Hal was arrested at his home when in fact, he was arrested miles away.
The arresting officer said that he had found Hal to be in possession of cocaine during a traffic stop. He later recanted this statement (under oath).

After being arrested and while downtown being processed, police then searched (ransacked) Hals home. There, they claim to have found three components to justify the arrest:

#1. In the garage, an (one) empty (in the indictment, the word empty was changed to can of but then later, corrected back to "empty")
can of break cleaner.

#2. On the porch, (along with the family's camping equipment), a half empty can of Coleman fuel.

#3. Inside the house, a cold capsule containing psudophedrine.

No smell, no actual meth, nothing else.

As for cocaine, the story now is (all available in court documents) it was supposedly found in the underwear of a woman at the house who as far as anyone knows has not since been seen or even charged with anything.
That's right, he (Hal) was charged with possession of a drug that was found in someone else's underwear and that person was NEVER ARRESSTED.

Also, keep in mind that Hal wasnt even at the house at the time. He was downtown being booked on these charges. Charges that were not even complete or filed at the time of his arrest.

It is our contention that this was the result of angering the wrong people and was all done in retaliation for the fact that Hal became aware illegal activity within the county. When he reported this activity to the proper authorities those involved were forced to cease said activities and therefore were put out of a very prospering and lucrative business.

Currently, after spending almost 2 years in the Coffee County, (TN) Jail, Hal is free on bond.
He has finally been assigned an attorney who first told him that much of this could be thrown out and that one of the charges was for something that wasnt even a law at that time. Possibly after intimidation by others, the same attorney is now attempting to encourage him to accept a totally unreasonable deal of time served with 6 YEARS probation or the possibility of 12 years imprisonment if he goes to trial. Those who know that Hal is innocent of all charges and know the entire story have encouraged him to reject this offer. This is based on the simple fact that it is an obvious plan to use his probation status to frame him for something else and then lock him away for good.
Hals trial is scheduled for August 2008.
During his previous time behind bars, he was refused (doctor ordered) medical treatment and prescribed medication.

We hope that through this petition, we will be able to gain public awareness of this type of abuse and discrimination against not only American Indians but also all incarcerated and falsely accused disabled persons who have been forced to suffer and pay the price for the corruption of others.
