On inadequate/ insufficient evidence
Mr. Tyson Edward Army was accused and arrested for a murder that happened on October 16, 2005 in the city of Detroit. The law states that Mr. Army is innocent until proven guilty. In Mr. Army case that is not true. Mr. Army went to trial on November 27, 2006. After this trial the jury deliberated for four days. They could not reach a unanimous decision. Mr. Army was not found guilty. He should be considered innocent. The state tried Mr. Army again this time Mr. Army represented himself, in an attempt to defend his innocence. After the trial the jury deliberated this time for seven days. Over a seven day period they looked over and examined each piece of evidence. That trial started on January 22, 2007. That jury could not reach a verdict. Mr. Army is still innocent. The evidence is inadequate to prove Mr. Army guilty of this crime. There is not one person who has testified that Mr. Army shot anyone. There is not one person who testified that they seen Mr. Army with a gun before, during or after the crime. Now the courts want to take Mr. Army to trial a third time on the same evidence. Mr. Army should not be forced to live through the strain, embarrassment, fear and ordeal and compelling him to live in a continuing state of anxiety and insecurity as well as enhancing the possibility that even though innocent he may be found guilty. Mr. Army should not be tried again on the same inadequate evidence. If indeed he is tried again. It makes the people question the integrity, fairness and public reputation of our judicial system. This is the voices of the people. If no retrial of Mr. Tyson Edward Army adequately protected Mr. Armys right to be free of a conviction on inadequate evidence, it is impossible to understand how not having a retrial here did not protect the prosecutions right to seek a conviction based on evidence. These are the voices of the people.
