We the undersigned taxpayers and citizens of the United States of America, do hereby make claim to be defrauded of a fair election process that appropriately used public funding. To wit, we assert that Senator John McCain has violated the intent and purpose of the public financing system for presidential contestants. We further assert that this constitutes a breach of existing codified law, as well as established ethics.

In simple terms, John McCain has violated the law and this petition asks you to hold him accountable. You can do so by signing your name here to register your support. Background to this petition and legal action is as follows:

I. Whereas, by the end of February Sen. John McCain, exceeded the $50 million limit he would have faced if he participated in the public financing system he had been certified to join, having spent $58.4 million in his primary bid.

II. And whereas, Senator John McCain did obtain a $4 million loan..agreement between McCain and Fidelity Bank & Trust. McCain secured the loan using his list of contributors, his promise to use that list to raise money to pay off the loan and by taking out a life insurance policy. Said agreement also said that if McCain were to withdraw from the public financing system before the end of 2007 and then were to lose the New Hampshire primary by more than 10 percentage points, he would have had to reapply to the FEC for public matching funds and provide the bank additional collateral for the loan.

III. And whereas, the benefit of having access to public funds was a tangible asset that was manifested to be operative in the wording of the aforementioned loan agreement.

IV. And whereas, other candidates who did not participate in public funding nor were certified for such, had no access to the same tangible benefit of the aforesaid.

V. And whereas, Sen. McCain qualified for the Delaware ballot by citing the FEC's approval of his application for matching funds, thereby avoiding the need to collect signatures.

VI. And whereas, the McCain campaign obfuscated the true ballot qualifying steps taken by erroneously stating that it got on the Kentucky ballot by collecting signatures.

VII. And whereas, Federal Election Commission Chairman David Mason (a Republican appointee himself), in a letter to McCain, said the apparent Republican nominee needs to assure the commission that he did not use the promise of public money to help secure a $4 million line of credit he obtained in November. He furthermore said, that the FEC would allow a candidate to withdraw from the public finance system if, and only if, he had not received any public funds and had not pledged the certification of such funds "as security for private financing."

VIII. And whereas, the McCain campaign has arrogantly stated that the Federal Election Commission cannot stop Sen. John McCain from withdrawing from the public finance system.

IX. And whereas, the Federal Election Commission has indeed become toothless because of the United States Senates failure to appoint commissioners to four existing vacancies, thus guaranteeing no quorum and no definitive decision from the six member Commission.

X. And finally, whereas, prior to exercising their right to vote, the people were denied specific knowledge of Sen. John McCains decision to overrun his spending limit and the potential consequences thereof.

Be it known, therefore, that although Sen. John McCain may enjoy default immunity from criminal prosecution because of Senate inaction, he must still answer to the People. This petition is not a mere expression of public opinion, but an invitation to action in civil court.
