The proposed legislation would...
- Authorize Rochester City Court to issue search warrants against the homes of citizens who are not suspected of any crime, merely because "the occupants and/or owner have not allowed the inspection without a warrant"
- Authorize a "fine of imprisonment" against person who should deny or unduly delay access to any premises
- Authorize Rochester City Court to issue search warrants to any officer or employee of the city, which NYS law only allows a police officer to do so as of now.
- Authorize search warrants without any suspicion much less probable cause that any crime has been committed
- Eliminate the constitutional requirement that a search warrant must particularly describe things to be seized
