The Abuses of Eminent Domain

Eminent domain refers to the power possessed by the state over all property within the state under the Fifth Amendment to the Constitution; the owner of any appropriated land is entitled to reasonable compensation, usually defined as the fair market value of the property. Last time I checked Forest City Ratner didnt own all New York property. Please stop the abuse!!



Forest City Ratners Atlantic Yards project,filed a lawsuit in the Eastern district, to stop the State of New York from taking their properties for the developer's private benefit through an abuse of its eminent domain powers. The suit says that the use of eminent domain for the "Atlantic Yards" project is unconstitutional. Forest City Ratner is taking away peoples homes and land that doesn't belong to him. Some people agree with the "Atlantic Yards" project, but it is wrong. They say that they will make more affordable housing and other necessities but the people who were there first were already getting that. They want to take land in prospect Heights, Brooklyn and are going to build the Brooklyn Nets Stadium.
