Emmett Earl Weeks murdered my Uncle Johnny in April of 1992 in my Aunt Pam's home in New Albany, Mississippi. Here is what we know of the tragic event.
Johnny E. Phagan (my uncle) had been vacationing in the Southern States from up state New York. He was on his way back to New York from Shreveport, La., via New Albany, Mississippi planning to stop and visit his sister Pam and her family.
The murder Emmitt Earl Weeks had previously stolen his girlfriends brothers truck. He drove the truck until he ran it out of gas. After doing so he put the hood up on the truck as a distress signal to ambush a Good Samaritan.
We were told that Johnny provided a ride to a stranded motorist near the Louisiana / Mississippi border. According to statement given by the murderer, Emmett Earl Weeks, he requested that Johnny give him a ride to Memphis, Tenn., but Johnny stated he was going as far as New Albany, Miss and would give him a ride that far.
According to the coroner, Johnny must have been in a kneeling position with his back to his murderer. Weeks shot Johnny not once in the back of the head but three times. He murdered my uncle execution style with a stolen handgun, in my aunts living room. Weeks then robbed Johnny of his money and credit cards and stole his van. Weeks traveled to Memphis and then back to Union County Mississippi where he tried to sell the van four days later.
Weeks stated he did it because he had to get to Memphis and he had had a fight with his girlfriend. He also stated that he had previously been on drugs.
Weeks confessed of the murder and plea-bargained for life instead of the death penalty.
Now he is up for parole.
Not only did he kill my uncle, a doctor of clinical psychology and very highly respected man by troubled youth whom he worked with in New York. He killed Johnny in my aunts living room where Johnny was found by her four year old daughter.
Beth rushed into the house before her dad and brother expecting to be greeted by her uncle, but instead she found him murdered.
My father, Pat Phagan, the rest of his brothers and sisters, Johnny's parents, and nieces and nephews will never truly get over the loss of Johnny Earl Phagan.
Emmett Earl Weeks - Inmate # 77493 was denied parole February 2002, but in 18 months the parole board will be making yet another decision that will effect not only my family and friends but those who might not even know Emmett Earl Weeks.
