This petition is to support the production of a bill regarding Driving Under the Influence of Drugs, as well as, Implied Consent for Blood Testing of Illegal Drugs. I have written this petition because my son, Michael David Pappert, age 19, was struck and killed while crossing the street by a man driving under the influence of cocaine and marijuana.
After waiting 5 months, I was informed by the prosecutors office that they didnt feel there was enough evidence to be able to say beyond a reasonable doubt that the amount of the drugs in his system at the time of the accident could be considered reckless. A reckless amount would be required to charge the driver with Vehicular Homicide in the state of New Jersey. The current laws only allow the police department to charge the driver with a DUI.
I also became aware, subsequent to Michael's death, that under current New Jersey laws, police officers may only perform a blood test if there is probable cause, i.e. paraphernalia or visible illegal drugs, found at the time of the accident.
