Dear The Honorable Chief Judge John M. Roll and Honorable Judge Susan Bolton,
We write to Your Honors to register our serious concerns about a legal case (CV07 1147-PHX-SRB) in U.S. District Court of Arizona , of which Your Honors are the Chief Judge and presiding Judge. This case has come to our attention through the Internet in both Chinese and English.
AiFang Shi, a Chinese pathologist, sued Central Arizona College (the "College") for wrongful and hasty dismissal from a nursing program due to discrimination and retaliation. Ms. Shi complained to the authorities at the College that the dean of the College made discriminatory statements towards her. Six days later, the College summarily terminated her with a fabricated accusation, alleging that she performed a procedure without faculty supervision while at a hospital. Ms. Shi's supervising nurse wrote a letter to the College, stating that Ms. Shi was innocent of this charge, yet the College still dismissed her.
During this lawsuit, the hospital produced the original document proving the Colleges accusation to be entirely false. The patients Medication Administration Record bears the signatures of the faculty member, proving that Ms. Shi completed the entire procedure under faculty supervision.
Ms. Shi paid out of state tuition to the College for the nursing program. Her nursing career was ruined by the Colleges discriminatory and wrongful conducts. She suffers continuous unemployment because of the wrongful termination.
After the U.S. Federal Court of Arizona granted summary judgment for Defendants with a notice of not for publication, Defendants filed a Motion for Attorneys Fees.
We ask the Honorable Chief Judge and presiding Judge to deny the Colleges Motion for Attorneys Fees. Awarding fees to racist Defendants would be further encouraging discrimination.
