We are concerned that when this plan goes into effect Jan. 1, 2011, it will put an undue burden on elderly who need to move twice a year (and have their prescriptions follow them) as they head south in the Winter and back to Ohio in the Spring. They would now have to have their doctor issue another prescription and perhaps that doctor would require an additional visit at which an additional co-pay may be required.
In addition, we are concerned about the lack of consumer choice and freedom to transfer. This change to Rule 4729-5-24 "Prescription Copy" could cause someone who tries another pharmacy (when lured by an Rx coupon for $10 to $30 gift card or similar value in free/discounted fuel) to become stranded at a pharmacy where they are not happy with the customer service or the pharmacist ... or at a chain that later that year is not convenient for them when they move to a different neighborhood or city within Ohio.
Wording in the new version of the rule also creates unfair competition for independent pharmacies and those that have a smaller/regional presence rather than a national one ... and for those chains that electronically share "a real-time, online database" of prescriptions. For these various reasons, we ask that you reconsider the change made to the rule and revert to the previous wording in place for the start of 2010.
If nothing else, you should at least require that pharmacies hand out a warning letter written by you that advises that a transfer would be a ONE-TIME thing under new rules enacted Jan. 1, 2011, and that they would no longer be able to move that prescription to a different pharmacy chain until a new script was written. Also, at minimum, the number of transfers allowed during the life of a one-year prescription should be expanded from ONE to TWO (if not to cover all refills as previously allowed).
