We respectfully submit this petition stating that the tenants of Magnolia Court are dissatisfied with the current conditions of the grounds.
Since January 2009 and the release of the Juan the gardener the grounds have not been kept in consistent condition and have been neglected resulting in debris and dead grass.
We understand that the lease agreement states on page 7 under section 11 that 11.3 Maintenance. During the term of this Lease, Landlord, at Tenants expense, shall operate, manage and maintain the Common Area so that they are clean and free from accumulations of debris, filth, rubbish and garbage
However, while we have been continuing to pay the CAM fee and water charges after Juans release, conditions of the grounds have deteriorated and currently include a large amount of magnolia leaves in the driveway and parking areas, weeds throughout the complex and perimeter, unkept and untrimmed hedges and dead grass throughout.
The condition of the common area decline are directly related to the release of Juan yet the tenants continue to pay the common area fees. In addition we have not see anyone on the premises performing these duties.
We ask for the following as an immediate course of action:
1. An inspection of the grounds and resolution in returning them to their former condition. (as seen on street view google maps)
2. A refund to all tenants of the CAM fee for a total of four months OR a cease in billing the CAM fee for four consecutive months moving forward from June through October 2009.
