This petition is from all parents with children aspirig for admissions into professional colleges in India & their wards:
The specific instance, pertains to scrapping of the time honoured CET - Common Entrance Test (TNPCEE), in Tamil Nadu (TN), by the State Chief Minister, ostensibly to help rural students, while a section of the public, aided by media reports, hold a view that there were larger political considerations, in view of the imminent State elections.
Passage of such a law, without adequate time for debate/contest by stake holders, ahead of the commencement of admission porcess, for the immediately following academic year, causes immense trauma & delay, directly affecting the future of the Children, whether they belong to the class that is supposed to benefit (in this case Rural Students) or not.
While such changes to the prevailing admission practice is an evolutionary & continual process, having to adopt with changing times, imposing them on the immediately following academic year does not give enough time for stake holders, including the State to make their case. In this instance (of Tamil Nadu), both the State board students & 'outsiders' suffer, due the delay, as (of March 2006) the matter is going through the State & Federal courts, with hardly a couple of months left for the normal start of the academic year 2006-07.
Irrespective of the merit of the case, the 2006 Rural Students dont know whether they have to write the CET or not; even worse, they may be told at short notice that they have to take the CET, without adequate warning or preparation time. On the other hand, the aggrieved non-State board Student community feels that a time-tested level-playing-field-for-all is being taken away by this act.
It is very clear that the admissions & commencement of the academic year 2006-07 is going to be delayed, well into September 2006.
We the petitioners request your Lordship, to pass an all India law that any proposed admission process change shall apply ONLY to the academic year that is atleast 15 months away, from the date such changes are proposed and/or promulgated.
