Right to Recall District Education Officer in India

I am voter of India. I order you to print the following DRAFT in the Gazette of the State Govt. The draft implements Right to Recall procedure over District Eudcation Officer

1. The word parent would mean a father and mother with a kid between age 0 to 17 who should also be a registered voter in that district ; Till the list of parent is made, every registered voter between the age of 23 years and 45 years will be deemed parent for the pupose of this GN. 

2. (procedure for Collector)  If any citizen of India wishes to become DEO (District Education Officer) , and he appears in person or via a lawyer with affidavit before the DC (or officer he deputes), the DC (or officer he deputes) would accept his application to become DEO after taking filing fee same as deposit amount for MP election.

3. (procedure for Talati  or Talati’s Clerks)  If a parent comes in person to Talati’s office, pays Rs 3 fee , and approves at most five persons for the DEO position, the Talati would enter his approvals in the computer and would him a receipt with his voter-id#, date/time and the persons he approved.

4. (procedure for  Talati)  The Talati will put the approvals of the parent on district’s website with citizen’s voter-ID number and names of the persons he approved.

5. (procedure for Talati) If a the parent comes to cancel his Approvals, the Talati will cancel one of more of his approvals without any fee.

6. (procedure for Collector) On every 5th of month, the Collector or officer he deputes will publish Approval counts for each candidate as on last date of the previous month.

7 . (procedure for CM) If a candidate gets approval of over 35% of ALL parents (ALL, not just those who have filed their approval) in a district, and it is 2% more than approval existing DEO has, then CM may appoint him as DEO

8. (procedure for CM ) As long as a DEO has approvals of more than 34% parents, CM need not replace him. But if a DEO’s approval goes below 34%, the CM can replace him with the officer of his choice.

9 . (procedure for CM , DEO) A person may become DEO with approval of parents, he may become DEO of more than one Districts. He may become DEO of at most 5 districts in the State and at most 20 districts in India. A person cannot be DEO of one District for over 8 years in his life. In case he is DEO of more than one district, he will get salaries , allowances, perks etc for the DEO positions of all those districts.

માનનીય ધારાસભ્ય,

હું ભારતની નાગરિક-મતદાર છું અને આપ મારા મારા વિસ્તારના ધારાસભ્ય છે. હું આપણે ચીને મુજબનું લખાણ ગેઝેટમાં છાપવા હુકમ કરું છું. આ લખાણથી અમો નાગરિકોને રાઈટ ટુ રિકોલ જીલ્લા શિક્ષણ અધિકારીનો કાયદો મળશે. 

1. વાલીનો અર્થ આ ગેઝેટ નોટીફીકેશનમાં તે માતા અને પિતા થશે જેને ૦ થી ૧૭ વર્ષનું સંતાન હોય અને તે માતા-પિતા તે જિલ્લાનાં નોંધાયેલ મતદાર છે. જિલ્લાનાં વાલીઓનું લિસ્ટ ન બને ત્યાં સુધી તે જિલ્લાનાં ૨૩ વર્ષથી ૪૫વર્ષનાં તમામ નાગરિક મતદારો આ ગેઝેટ નોટીફીકેશન માટે વાલી ગણાશે.

२. ( કલેકટર માટેની પ્રોસીજર)  જો ભારતનો કોઈપણ નાગરીક જિલ્લા શિક્ષણ અધિકારી (ડી.ઈ.ઓ.) બનવા માંગતો હોય અને તે કલેકટરની (કે કલેકટર દ્વારા નિમાયેલ અધિકારીની ) રૂબરૂમાં અરજી આપે, તો કલેકટર સાંસદની ડિપોઝીટ જેટલી રકમ લઇ તેનું નામ નોંધી, સિરિયલ નંબર આપશે.

३. ( તલાટી  અથવા તેનો ક્લાર્ક માટેની પ્રોસીજર )  જો કોઈ વાલી તલાટીની કચેરીએ આવી રૂ.૩ ફી આપી ૫ વ્યક્તિઓને સ્વીકૃતિ આપે, તો તલાટી તે સ્વીકૃતિઓ કોમ્પ્યુટરમાં એન્ટર કરશે અને વાળીને તેના ફિંગરપ્રિન્ટ અને ફોટાવાડી પહોચ આપશે, પહોચમાં વોટરકાર્ડ નંબર, સ્વીકૃતિ મેળવનારાઓના નામ-નંબર, તારીખ રહેશે. આ ફી બીપીએલ કાર્ડ ધારકો માટે રૂ.૧ રહેશે. (તલાટી માટેની પ્રોસીજર ) તલાટી વાલીનું વોટર નંબર અને સ્વીકૃતિ મેળવનારાનું નામ-નંબર કલેક્ટરના વેબસાઈટ પર મુકશે.

४. ( તલાટી માટેની પ્રોસીજર )  વાલી તલાટીની કચેરીએ જઈ વોટરકાર્ડ બતાવી કોઈપણ દિવસે ફી આપ્યા વિના આપેલ સ્વીકૃતિઓ કેન્સલ કરી શકશે.

५. ( કલેકટર માટેની પ્રોસીજર ) કલેકટર દર મહિના પાંચમી ૫ તારીખે ઉમેદવારોને મળેલ સ્વીકૃતિઓનો આંક વેબસાઈટ પર મુકશે.

६. ( મુખ્યમંત્રી માટેની પ્રોસીજર ) જો કોઈ ઉમેદવારને તમામ વાલીઓનાં ૫૧% થી વધારે વાલીઓની સ્વીકૃતિ મળેલ હોય અને તે વર્તમાન જિલ્લા શિક્ષણ અધિકારીને મળેલ સ્વીકૃતિઓ કરતાં ૨(%) ટકાથી વધારે હોય તો મુખ્યમંત્રી તે ઉમેદવારને જિલ્લા શિક્ષણ અધિકારી તરીકે નિમી શકશે અથવા ન પણ નીમે. મુખ્યમંત્રીનો નિર્ણય અંતિમ રહેશે.

७. (  મુખ્યમંત્રી માટેની પ્રોસીજર ) જ્યાં સુધી જિલ્લા શિક્ષણ અધિકારીઓ પાસે ૩૪% નાગરિકોની સ્વીકૃતિ છે, ત્યાં સુધી મુખ્યમંત્રી તેની બદલી નહિ કરે, પણ જો જિલ્લા શિક્ષણ અધિકારી પાસે સ્વીકૃતિઓ ૩૪%થી ઓછી થશે, તો મુખ્યમંત્રી તેને બદલી શકશે.

८ . ( મુખ્યમંત્રી માટેની પ્રોસીજર ) ચાલુ કાયદાઓ મુજબ કેન્દ્ર સરકાર, રાજ્ય સરકાર અને જિલ્લા પંચાયત પાસેથી રકમ મેળવશે જિલ્લા શિક્ષણ અધિકારી ધોરણ-૧ થી ધોરણ-૧૨ ની શાળાઓ અને પરીક્ષા કેન્દ્રો ચાલુ કાયદાઓ મુજબ સંચાલન કરશે. જિલ્લા શિક્ષણ અધિકારી તે જિલ્લામાં આવેલ તમામ શાળાઓની ફીનું નિયંત્રણ કરશે અને નિયમાનુસાર અન્ય જવાબદારીઓ સંભાળશે.

૯. ( મુખ્યમંત્રી માટેની પ્રોસીજર ) નાગરીકોની સહમતીથી એક વ્યક્તિ રાજ્યમાં ૫  અને ૧૦ માં દસ જીલ્લાનો જીલ્લા શિક્ષણ અધિકારી બની શકાશે.
