For years, software programmers have brought us the gift that is the video game emulator - a computer program which allows gamers all across the world to play their favorite classic video games on their computers. For some of us, the idea of purchasing old video game consoles and cartridges requires far too much money and effort, especially with a free alternative such as emulation available. However, such companies as Nintendo of America and Sega of America have decided to take legal action against any and all webmasters who host such files on their websites.
Considering that these companies can no longer possibly turn a profit from archaic game systems that are no longer in production, there is no reason why the video game producers of the world should be taking legal action over the distribution of said files. Yet they still have their corporate lawyers mailing threatening letters to webmasters on an all-too-frequent basis in an attempt to eradicate emulation. The idea of emulation will never be eradicated, however. Menacing lawyers have only pushed the webmasters hosting such software into the underground, where two new sites are born for every site struck down.
The only thing that this harassment is causing is a difficult time for people who want nothing more than to enjoy the video games they grew up on. Therefore, we call for the legalization of all emulation software ("emulators") and the associated read-only memory files ("ROMs") of all video game systems which are no longer in active production, and whose games cannot be utilized with a current gaming system.
For example, PlayStation games would not be included in this motion, as PlayStation games are fully compatible with the currently-produced PlayStation 2. However, games for the Nintendo Entertainment System (NES), Super Nintendo Entertainment System (SNES), Sega Genesis, or Sega Game Gear would be included.
Thusly, we call upon both the video game companies and the United States government to legalize the emulation of out-of-production video games as outlined above by releasing them as public domain
