Your Excellency

WITHDRAW SGs PANEL APPOINTED AS IT WILL BE COUNTER PRODUCTIVE AND LEAD TO UNREST AND INSTABILITY IN SRI LANKA

You have appointed a panel to investigate into the last phase of Sri Lankas military action despite the UN Human Rights Council in Geneva rejecting such a proposal by 29 to 12 votes. We are of the view that you have no authority from any decision making body in the UN to insist on such a measure.

You have clearly exceeded the powers prescribed in Chapter 15 of the UN Charter where your role as the Chief Administrative Officer and the limits of your authority are detailed. Your appointment is arbitrary and precedent setting. For you to act without express UN Security Council authorization would far exceed the legitimate authority with implications to all UN member nations. As to where the funds will be made available for this arbitrary action remains a mystery.

What should be noted by you and the other member nations is that there was peace and tranquility in Sri Lanka after the Tamil Tiger Terrorists were defeated after 33 years of unmitigated violence until you decided to appoint the ill advised panel. Now the genie of intolerance has been let out of the bag.

Sri Lankan people will never agree to outside interference in the domestic affairs and will resort to mass political action paving way for instability and unrest, street marches and violence, thanks to you. Your imprudent act will permit demonstrations, mass action to occupy the centre stage of Sri Lankan politics distracting Sri Lankans from their efforts to RECONCILE, RECONSTRUCT AND REINTEGRATE. The countrys effort to develop peacefully will be diluted.

Your choice of the panelists reveals that you have a pre-determined strategy to find fault with Sri Lanka. The Chairman of the panel, Marzuki Darusman was a member of an international team appointed to observe proceedings of a previous Sri Lankan commission and left in a huff squabbling over fees with strong anti-Sri Lanka feelings. He was once the Attorney General in Indonesia and had to quit under a cloud as he was said to be having links to the shady and the corrupt in Indonesia. Steven Ratner, a member of the panel has written that Tamils represented by the LTTE are an oppressed minority, making him a biased person. Both are disqualified to sit in judgment on Sri Lanka. Of course, the goal was to nail Sri Lanka somehow or other, you have ignored this aspect purposely.

Your latest statement that the panel will be advisory is contradicted by Darusmans statements indicating his desire to convert it to an investigating panel.

Without obstructing the post-war development and peace in Sri Lanka-a country emerging from a 33 year war- and also making a mockery of the UN machinery, we request you to discuss this controversial. arbitrary and precedent creating panel with Sri Lanka and other responsible members /groups in the UN so that a respectable exit strategy will be worked out for more constructive and a productive program for Sri Lanka and regional peace and prosperity. Let Sri Lanka handle this issue applying international best practice.
