WHEREAS, section 1-13-109 of the Colorado Revised Statutes (C.R.S. 1-13-109) specifically states: (2) (a) No person shall recklessly make, publish, broadcast, or circulate or cause to be made, published, broadcasted, or circulated in any letter, circular, advertisement, or poster or in any other communication any false statement designed to affect the vote on any issue submitted to the electors at any election or relating to any candidate for election to public office notwithstanding any other provision of law, for purposes of this subsection (2), a person acts "recklessly" when he or she acts in conscious disregard of the truth or falsity of the statement made, published, broadcasted, or circulated (emphasis added),
WHEREAS, the so-called Trailhead Group has been found to have made, sponsored, or caused to be made automatic telephone calls known as robo-calls against as many as six elected officials, Democratic members of the Colorado House of Representatives, making statements with no basis in fact,
WHEREAS, Colorado Democratic Party Chair Pat Waak has already filed a formal complaint with Colorado Attorney General John Suthers (AG Suthers), and at least three other elected officials who have been targeted by Trailhead Group robo-calls have filed formal complaints either with AG Suthers or with County District Attorneys,
BE IT RESOLVED THAT:
1.The Colorado Democratic Party and the people of Colorado officially demand that AG Suthers launch a full and formal investigation of the robo-calls and any connected activities which were made, sponsored or caused to be made by the Trailhead Group, and any groups or individuals connected or affiliated with the Trailhead Group.
